If you’re an owner of some of the early Apple Watch modes, you might be eligible for a payment from $20 million Cupertino based giant has agreed to pay. The iPhone maker is settling the case revolving around its Apple Watches Series 1, Series 2, and Series 3 models. For those unaware, these Apple Watches were suffering from an issue that caused their batteries to swell up, leading to damage to the wearable device.

Despite Apple agreeing to settle this lawsuit, it has officially stated that it strongly disagrees with the claims made in the lawsuit. But the company “agreed to settle to avoid further litigation.” Furthermore, the exact amount of payments made varies since it depends on the number of people who come forward with their claims. However, we can expect early Apple Watch users to get around $20 to $50.

Keep in mind that users should’ve reported the issue to Apple in the US between 4th April 2015 and 6th February 2024. The website linked above also adds that the “Settlement Class Members will receive a payment without the need to submit a claim form”. There’s some good news for Apple Watch users in the US who miss the blood oxygen monitoring function. As per recent developments, there is a chance for its return, though the timeline is quite uncertain – and possibly very long.

Apple is trying to appeal the ban, which may result in a sooner reinstatement

Remember when Apple was sued by Masimo for infringing the pulse oximetry technology used to measure blood oxygen levels? This decision affected the Apple Watch Series 9 and Apple Watch Ultra 2. Documents from the U.S. Customs and Border Protection (CBP) indicate Apple can potentially resume selling Apple Watches with the blood oxygen feature by August 2028 at the latest. This coincides with the expiration of the patent Apple was found to have infringed upon.

However, this isn’t the only factor at play. Apple is actively appealing the ban imposed by the U.S. International Trade Commission (ITC). If their appeal is successful, the blood oxygen functionality could return sooner than August 2028.

The whole situation is further complicated by the lack of a settlement between Apple and Masimo, the patent holder. As of now, a licensing agreement seems unlikely. Reports state that Masimo’s CEO remains open to discussion but hasn’t engaged with Apple yet.

That’s not all. Masimo is raising concerns that Apple might enable the blood oxygen function on jailbroken iPhones through software updates. They’re advocating for stricter restrictions, ideally at the hardware level, to prevent this possibility. This fiasco might end up costing Apple billions of dollars since Apple Watches are some of its most popular products next to the iPhones and Macs. A federal judge in Manhattan has dismissed a lawsuit brought against Apple, alleging improper compensation to CEO Tim Cook and other top executives. Certain Apple Watch imports were prohibited after the US International Trade Commission (ITC) found in October that Apple had violated Masimo’s patents for a blood oxygen sensor. According to Bloomberg, Apple engineers are “racing” to change the algorithms used for the blood oxygen sensor in the Apple Watch to avoid having to stop selling the watch.

Apple said earlier today that it will stop selling the Apple Watch Series 9 and Apple Watch Ultra 2 in the United States from December 21. The sources who talked to Bloomberg stated that engineers are reportedly changing how oxygen saturation is calculated and how users receive the data. These adjustments are likely to eliminate technology that is purportedly infringing on Masimo patents.

This action aligns with Apple’s announcement that it is “pursuing a range of legal and technical options” to ensure that sales of Apple Watch can get back on track as quickly as feasible. Hardware covered by Masimo’s patents powers the Apple Watch blood oxygen sensor, and Masimo thinks that a software update won’t be sufficient to resolve the patent infringements. According to Masimo, “the hardware needs to change,” as reported by Bloomberg.

However, the company appears to believe that a software-based solution will be enough, as a representative informed Bloomberg that it is working on submitting a workaround. Given that Apple will need to test the modifications, it seems doubtful that a software update will be released before the end of sales. Updates to the hardware would take at least a few months.

Now, the company has taken the initiative to prepare for compliance with the ITC’s ruling, even if the White House has until December 25 to decide. The Watch Series 9 and the Watch Ultra 2 will no longer be available for purchase at stores in the US from December 21 at 2:00 PM Pacific Time. Additionally, online sales will also stop after December 24.

However, The Apple Watch SE will still be available in other nations in addition to the Apple Watch as it is not equipped with a blood oxygen sensor. The business plans to appeal the ITC’s decision to the U.S. Court of Appeals for the Federal Circuit on December 26 if a motion to reconsider is not given.

A Presidential Review Period is in progress regarding an order from the U.S. International Trade Commission on a technical intellectual property dispute pertaining to Apple Watch devices containing the Blood Oxygen feature. While the review period will not end until December 25, Apple is preemptively taking steps to comply should the ruling stand. This includes pausing sales of the Apple Watch Series 9 and Apple Watch Ultra 2 from Apple.com starting December 21, and from Apple retail locations after December 24. The decision does not impact sales of the devices in other countries at this time.

Apple's teams work tirelessly to create products and services that empower users with industry-leading health, wellness, and safety features. Apple strongly disagrees with the order and is pursuing a range of legal and technical options to ensure that Apple Watch is available to customers. Should the order stand, Apple will continue to take all measures to return Apple Watch Series 9 and Apple Watch Ultra 2 to customers in the U.S. as soon as possible.

Apple is facing yet another lawsuit. This time, the company is being sued for its Apple Watch wearable device, which the legal complaint states is racially biased in some of its key health related features.

The Cupertino based giant has been hit with a class action lawsuit in the Southern District of New York. The brand is facing the legal dispute over its smartwatch allegedly having a racial bias on darker tones for its blood oximeter health feature. According to the documents, a New Yorker named Alex Morales is claiming that the Apple Watch that he purchased over a year ago is “purported to measure blood oxygen levels and he believed it did this without regard to skin tone which was relevant to him based on his skin tone.”

As per the legal filing, Morales “expected the product would not incorporate biases and defects of pulse oximetry with respect to persons of darker skin tone.” He further added that “as a result of the false and misleading representations, the Product is sold at a premium price, approximately no less than $400, excluding tax and sales.” So Morales is filing a class action law suit, which will also cover all New Yorkers who purchased the Apple Watch during the statute of limitations. Furthermore, the lawsuit also listed research notes from a study that was conducted during the pandemic.

This was done to help test COVID-19 cases by checking the blood oxygen saturation percentage. They cited this research and stated that it “confirmed the clinical significance of racial bias of pulse oximetry. For decades, there have been reports that such devices were significantly less accurate in measuring blood oxygen levels based on skin color.” Apple has responded to this lawsuit saying that the Apple Watch is “only designed for general fitness and wellness purposes. Blood Oxygen app measurements are not intended for medical use, including self-diagnosis or consultation with a doctor.”

The Cupertino based giant is facing a lawsuit from two women that have faced stalking by the use of AirTag. Since its launch, the smart tracking device has been used to track victims and even used by car thieves and others. Apple has tried to fix this issue multiple times but people are still using it for malicious purposes. This time, two women have filed for a lawsuit after the AirTag was used to track them by their former partners. According to the legal documents, the device was used to stalk the two victims and that the company did “little, if anything, to swiftly warn consumers if they are being monitored.”

One of the people affected by this incident stated that her ex boyfriend had planted an AirTag in the wheel of her car and was able to figure out her location. This person then used the location information to harass her. The other woman filed the lawsuit after her husband put an AirTag in her child’s backpack to track her. So now, the two ladies are suing the iPhone maker and are seeking an unspecified amount of monetary damages and are accusing Apple of launching a dangerous product.

Apple smartwatches offer a unique functionality tied into the Apple ecosystem called Auto Unlock. Using this feature, Apple users can easily unlock their Macbooks and iPhones without the need for a password or Face ID. This feature was first announced in June 2016 by the company.

Now, according to a Patently Apple report, a company called SmartWatch MobileConcepts LLC is suing the Cupertino giant on grounds of patent infringement regarding the Auto Unlock feature. The patent the company SmartWatch MobileConcepts LLC is referring to is patent 10,362,480 titled “Systems, Methods, and Apparatuses for Enabling Wearable Device user Access to Secured Electronics Systems”. The patent was acquired by the firm from the members of the Ortiz family.

According to the report, this appears to be an instance of patent trolling to make the Cupertino giant cough up some cash via a settlement or a legal dispute. For those unaware, a patent troll is a derogatory term used to describe a business that utilizes patents and the court system to earn money.

However, things might not go as planned for SmartWatch MobileConcepts LLC as the above-mentioned patent was filed with the United States Patent and Trademark Office (USPTO) on August 11, 2016, whereas, Apple announced this feature during WWDC 2016 which ran between June 13 to June 17, almost two months before the patent was filed. It remains to be seen how the court will decide upon this matter, so stay tuned for more updates.

A judge has ruled against Apple and has said that the company must compensate a customer in Brazil for selling the person an iPhone without a charger included in the box.

According to a MacRumors report, the Cupertino based giant selling an iPhone without a charger in the box violates consumer laws. For those unaware, the iPhone maker had removed the charger in the box back in 2020. The company cited environmental reason for this decision, however, many believe that the company made the move to save up on shipment costs thanks to smaller retail boxes. Not shipping chargers also help further reduce their costs as well.

Thus, the move sparked controversy with certain governments even taking steps against the company, requiring them to ship its iPhones with the chargers. Now, a judge in Brazil, which is a region that has been against Apple’s move, is now forcing the company to compensate the customer for more than 1,000 US Dollars for the lack of a charger. Back in 2021, Brazil had also fined the company 2 million US Dollars for violating consumer laws.

This dispute continued and, at one point, it seemed that Apple would be required to ship every iPhone with a charger in the country. However, the company argued that many customers already have chargers in their homes. The brand even stated the environmental benefits of removing chargers and the reduced footprint of the iPhone box.

Earlier this week, a federal judge in the US said that Apple is facing a claim that states that it is illegally holding a monopoly over its heart rate monitoring apps on its Apple Watch in the United States market.

According to a Reuters report, US District Judge Jeffrey White stated that AliveCor Inc has claimed that it can prove that the Cupertino based giant has violated federal antitrust law. As per the claim, the iPhone maker allegedly has “complete control” on the market over similar apps. For those unaware, AliveCor Inc is behind the SmartRythm app that alerts the users to irregular heartbeats.

The judge added that “AliveCor alleges that Apple made changes to the heart rate algorithm that made it effectively impossible for third parties to inform a user when to take an ECG. Plaintiff’s allegations plausibly establish that Apple’s conduct was anticompetitive.” At the same time, Judge White also dismissed a separate claim for AliveCor, which claimed that Apple maintained an illegal monopoly over its ECG enabled smartwatches. Unfortunately, Apple has yet to provide any comments regarding this matter. Although, this isn’t the first time AliveCor has filed a complaint against the brand.

Back in 2020, the company had accused Apple for infringing on its patents based on its ECG features. In 2021, it also claimed that AliveCor was accused of changing the heart rate algorithm, which gave its proprietary system an “unfair competitive edge” over its competitors or possibly even putting “countless AliveCor users’ lives in danger” since they rely on their systems to offer them alerts. However, the American brand had countered this claim by saying that it was an “uncontroversial proposition that product improvement by itself” and did not violate the federal Sherman antitrust law.

Now, we have a similar situation at hand where Apple has issued a legal notice against the Ukrainian indie film director Vasyl Moskalenko, who wrote the comedy film titled Apple-Man.

If you think that this film might have to do something with Apple (the company) or its products then you are mistaken. The movie is a satire based on the superhero genre and its protagonist “Apple-man” has the superpower to levitate Apples (fruit) which he uses to fight his enemies. The film was crowdfunded through Kickstarter and raised $120,000 to begin production.

The movie has already been approved by the United States Patent and Trademark Office (PTO), Apple is seeking to have the trademark registration application denied by mounting “an aggressive opposition.”

The Cupertino giant has initiated trial proceedings against the director over concerns that consumers are likely to believe that “Apple-man is associated with, approved by, or even endorsed by Apple” the company stated in a 467-page court filing.

Director Moskalenko has stated that his movie is about Apples, the fruit, and there is no mention of Apple (the company) in his movie.

The indie movie director stated in an interview that  “if my registration would be denied, there are no guarantees that Apple wouldn’t demand to delete my film after its release.”

“It actually looks like a trademark bullying,” added Moskalenko. “I still hope this situation is just a misunderstanding. I am open to negotiations and hope we can resolve this dispute,” concluded the Ukrainian filmmaker.

According to The Verge, Krafton Inc is suing Garena for developing two games that are allegedly a copy of its existing title, PUBG: Battlegrounds. This was the original battle royale game that kicked off the BR trend while also spawning its popular mobile spin offs as well. However, Garena is facing the lawsuit owing to its two mobile games, namely Free Fire and Free Fire Max. Furthermore, the company is even suing the two tech giants Apple and Google for distributing the game.

According to an official statement from Krafton, “Free Fire and Free Fire Max extensively copy numerous aspects of Battlegrounds, both individually and in combination, including Battlegrounds’ copyrighted unique game opening “air drop” feature, the game structure and play, the combination and selection of weapons, armor, and unique objects, locations, and the overall choice of color schemes, materials, and textures.”

Krafton is also accusing Google for hosting YouTube videos with gameplay of the two games as well as “numerous posts containing a feature-length Chinese film that is nothing more than a blatantly infringing live action dramatization of Battlegrounds.” For those unaware, Garena’s Free Fire and Free Fire Max is available in both App Store and Play Store for free. The PUBG developer even added that Garena has earned hundreds of millions from in game sales through Apple and Google app stores.

Back in January 2020, we had reported on Apple being accused of stealing Health Monitoring technology for its smartwatch. Now, this lawsuit battle has been waging for nearly two years with no end in sight.According to a Bloomberg report, the Cupertino based giant has denied Masimo’s accusations of stealing its trade secrets for the Apple Watch. Masimo CEO, Joe Kiani, has stated that “I’ve been through three major litigations,” but he believes that the known smartphone maker is taking this battle to another level. He further added that the company is “refusing to even play by the rules set by the court.” Meanwhile, Masimo, a signal processing technology maker for health care monitors, accused the brand of stealing its trade secrets through the hiring of one of its former executives.

The legal battle has been stalled for nearly two years, as the iPhone maker challenges the validity of the patent and disputes over access to information. Kiani said that these delays had prompted him to file a complaint with the International Trade Commission (ITC) to block the imports of the Watch Series 6 as well. For those unaware, Apple had hired Masimo’s chief technology officer, Marcelo Lamego, at Cercacor (Masimo’s subsidiary) and had allegedly filed new patents under his own name that were previously filed by Masimo.

Furthermore, Kiani also stated that Apple’s CEO Tim Cook might have been personally involved in the hiring of the Cercacor executive as well. Kiani added that “Patents began publishing with Marcelo Lamego as inventor. He had patented things, some of the things we had done 20 years ago and were in our products. This was worse than we thought. That’s when we first sued Apple.”

Apple has just been hit with another lawsuit earlier this week. XR Communications filed a lawsuit against the company alleging that a number of its products infringed on its MIMO wireless technology patent.

The firm filed a complaint with the US District Court for the Western District of Texas (Via AppleInsider) against the Cupertino based giant for infringing on a single patent granted in 2020. In the lawsuit, a number of products were mentioned, including the iPhone 6s and higher, every iPad model from the first generation, iPad Air and iPad mini 2, all Mac models launched since 2016, and the Apple TV 4K. XR Communication cited the infringement of US Patent No. 10,715,235 for ‘Directed wireless communication.’

While the technology cited in the lawsuit is specific, the system described in the complaint is used by a large number of manufacturers in the market that offer devices with Wi-Fi capabilities. The patent in question was developed by now defunct WiFi infrastructure specialist Vivato Technologies, which was founded back in 2000. While the iPhone maker already owns a number of patents related to MIMO communications and related technologies, XR Communications lawsuit, filing as Vivato, is seeking damages for past and ongoing royalty, court fees, and injunctive relief in its case.

The Apple Watch is at the center of another lawsuit as the company is facing another antitrust charge over its ECG system that it has allegedly “copied”, as per a medical firm AliveCor.

According to an AppleInsider report, the mobile medical company AliveCor has previously filed a patent infringement suit against the Cupertino based giant in Texas, US. The firm has also asked the US International Trade Commission to ban sales of the iPhone maker’s smartwatch. Now, AliveCor is also requesting a trial by jury over patent issues and has filed a lawsuit in the Northern District of California.

As per the filing, AliveCor is claiming that the smartphone manufacturer initially supported the development of an electrocardiogram wristband, the Kardiaband. The lawsuit states that “Apple not only initially approved AliveCor’s apps but also advertised AliveCor’s innovations to sell more Apple Watches. AliveCor informed Apple about [it gaining] FDA clearance and that it intended to begin selling KardiaBands shortly along with its previously-approved Kardia and SmartRhythm apps.”

The filing adds that “Apple had finally realized heart health analysis was incredibly valuable to (and desired by) smartwatch users, and thus had been working in the background to copy AliveCor’s ideas, including both the ability to record an ECG on the Apple Watch, as well as to provide a separate app for heartrate analysis.” Unfortunately, the smartphone brand has yet to comment on the new filing.

Apple and Qualcomm are facing a lawsuit as both companies are accused of patent infringement. The lawsuit targets certain 5G technologies that are used by both companies, which infringes on an RF calibration patent.

According to an AppleInsider report, lawsuit was filed in the US District Court for the Western District of Texas last week. It alleges that a handful of the chip makers 5G wireless transceivers infringe on its patent. Similarly, it further adds that the iPhone 12 series from the Cupertino based giant uses these infringing transceiver technology, as the lineup incorporates Qualcomm’s 5G modems.

To be specific, the lawsuit targets Qualcomm’s SMR526, SDR865, and SDX55M as the infringing products. The party suing both tech giants is Red Rock, who owns these patents. The lawsuit also alleges that both Apple and Qualcomm had prior knowledge of the existing patent, and the lawsuit alleged that Qualcomm had received notices of the existence of the patent at least three times between the years 2008 and 2011.

Furthermore, the lawsuit states that the actions taken by the iPhone maker and Qualcomm “have been, and continue to be, committed in a knowing willful, and egregious manner and constitute willful infringement of” the intellectual property. At the moment, the complaint seeks a jury trial and a long list of prayers for relief, including enjoinments barring Apple and Qualcomm from infringing on the patent, along with royalty payment and even cover for damages as well.

Apple has announced that it plans to argue that it faces competition in the video game market in its lawsuit battle against Epic. The company claims that it has competition in the market for video game transactions.

For those unaware, the Cupertino based giant is facing a legal battle against the video game publisher, who filed an antitrust allegation against the firm. The studio behind Fortnite sued the iPhone maker over the 15 to 30 percent commission that it charges for the use of its in app payment systems. The studio also called out Apple’s longstanding practices of exerting complete control of deciding which apps are allowed to be installed on its devices, implying anti competitive behavior.

Last year when Epic launched an in app payment system that bypassed Apple’s commission, the latter removed Fortnite from its App Store. At the moment, the case is expected to be heard in Oakland, California in the US in May 2021. Epic has built its case around the billion strong userbase of the iPhones, which represents a distinct market for software developers, as per a Reuters report. So, the company is claiming that Apple is abusing its position and forcing developers to pay fees on transactions.

In a filing that Apple plans to make, it rejects the notion and states that the proper market to analyze the case in the video game transaction market. In other words, it is arguing that platforms such as Nintendo and Microsoft Xbox gaming consoles also limit the hardware that can run on their platforms and charge a fee as well. Apple is facing another lawsuit. This times the company is being sued for a faulty iPad, which might have been the reason for a house fire. The lawsuit was filed by the law firm de Luca Levine.

According to a PhoneArena report, the incident occurred at Macaluso’s resident in Milford. His insurance company, Allstate Insurance, covered the entire expenditure for for repairs over the fire damage, which costed around 142,000 US Dollars. de Luca Levine is representing the insurance firm and is suing the Cupertino based giant to reimburse the insurer’s payout. The lawsuit alleged that the fire was caused due to a malfunctioning electrical/battery system of the Apple iPad.

Furthermore, the complaint had also added that Macaluso had not “misused, or altered it [his iPad] beyond anticipated handling and operation intended by Apple.” It went on the accuse the iPhone maker of selling a defective/faulty product. The lawsuit was filed in the Court of Common Pleas of Philadelphia County, Pennsylvania earlier this month and was moved to a federal district court this week.

Similar to this lawsuit, the company also is involved in another ongoing case of a man dying due to a fire caused by another iPad’s faulty battery, which caused a spark. In other words, cases resembling this lawsuit have also been seen in the past, although, these are still rare cases. These devices also use Lithium ion batteries that are known to be volatile, however, future devices are expected to shift to graphene cells, which are better at conducting heat.

In what could be a strong evidence of insiders within an organisation leaking confidential and privileged trade secrets for personal gain, Apple has instituted a lawsuit against its former employee, Simon Lancaster. Lancaster who rose to become a highly placed materials lead on the company, is accused of deliberately accessing highly classified information about upcoming products by Apple and selling the information to the media in several instances. The trade secrets were thought to be sold in exchange for favorable coverage of a startup by the unnamed media organisation.

In a case filed by Apple against Lancaster, which was spotted be Apple Insider, the former Apple staff who was an Apple employee from 2008 to 2019, was accused of abuse of his position and trust within Apple by systematically disseminating Apple’s sensitive trade secrets to curry personal benefits from a media outlet. Being a senior official, Lancaster was accused of accessing internal trade secrets from documents outside the scope of his job specification and responsibilities and transferring the same to a media correspondent, who then published the stolen materials in the unnamed media platform in several articles.

Lancaster was further accused of accessing unauthorized Apple trade secrets even after leaving Apple for a materials research and development firm, Arris which was an Apple vendor, in clear breach of the extant agreement between both companies. In the wake of the continued transfer of Apple trade secrets to the media correspondent even after leaving Apple, an investigation ensued with a scrutiny of the devices used by the accused former staff. The investigation revealed that Lancaster indeed took specific steps to steal additional Apple trade secrets after he left the company. He was accused of being in regular communication with the correspondent, and sent specific details upon request, even using Apple-issued devices in some instances. 

Apple claimed Lancaster had, through his deliberate actions, breached the Defense of Trade Secret Act, California’s Uniform Trade Secret Act, and a written contract. Apple therefore is requesting the court to grant all the reliefs it has sought, including damages, restitution, and costs of the lawsuit.

Apple is facing another lawsuit. This one arrives after an iPhone X model exploded in the pockets of an Australian man. The incident originally occurred back in 2019 but the man is taking legal action now after the company failed to respond to his inquiries about the problem.

According to a 9To5Mac report, the Australian Scientist, Robert De Rose, was sitting in his office when he felt a sudden pain in his leg and heard a fizzing sound from his pocket. As per Robert, “I heard a faint pop sound, followed by a fizz, and then I felt intense pain on my right leg, so I immediately jumped up and realized it was my phone.” After pulling out his iPhone X from his pocket, he noticed that his just one year old device had smoke coming out of it.

The exploding iPhone X caused “second degree burns” on his legs. He further added that “I had ash everywhere, and my skin had peeled back.” Furthermore, De Rose reportedly reached out to the Cupertino based giant multiple times regarding the issue, but was never met with a response. Thus, the Australian scientist has filed the lawsuit working with Carbone Lawyers n taking legal action against Apple over compensation.

Notably, the firm is also representing another person from Melbourne who claims “he was left with a burnt wrist after his Apple Watch overheated.” At the moment, the company is investigating both the complaints, which have been filed with the County Court. Apple is constantly in the news not only for its products and services but for facing lawsuits as well. A new lawsuit filed by an Italian Consumer Protection agency could cost the Cupertino giant up to 60 million euros if it loses.

Italy’s Altroconsumo has filed a class-action lawsuit against Apple in the Court of Milan. It says that the company has deceived consumers with practices of “planned obsolescence”. That is, the lawsuit is for more than 1 million units of affected iPhone 6, 6 Plus, 6S, and 6S Plus sold between 2014 and 2020.

It is referring to the performance throttling(“batterygate”) that Apple’s iPhone 6-series devices faced then. A similar issue made Apple pay a whopping $500 million back in March 2020. Also, this new lawsuit comes a month after the company was slapped with a 10 million euros fine in Italy over “misleading claims regarding water resistance”.

Anyway, Altroconsumo is asking for a compensation of about €60 million(~$73 million). It is trying to convey that Apple is using unfair practices to slow down the older iPhones through software updates which inturn degrades battery. To cover up the contested throttling issue, Apple had reportedly opened a “battery replacement campaign” at a reduced price(€29-€89).

While the earlier lawsuit in US-made Apple pay $25 to each affected consumer, this one would amount to about 60 euros per concerned person. Apple has been facing a lot of “batterygate” lawsuits in Europe lately. Italy is the latest to join the countries like Belgium and Spain which filed a similar one last month.

Although Apple had denied a planned batterygate campaign, it has admitted in the past that the processor’s clock speeds will reduce if the battery degrades. Let’s see how it handles this one as Portugal prepares to join with its own lawsuit soon.

Ivo Tarantino, External Relations Manager of Altroconsumo says, “We hope this is the last step to remedy the damage caused to date by the company but it is also the first step towards greater fairness by Apple towards its consumers”.

According to an Apple Insider report, the complaint was filed with the U.S. District Court for the Western District of Texas earlier this week. The lawsuit alleges that the Cupertino based giant knowingly infringed on five pieces of intellectual property owned by Delaware-based Neo Wireless, LLC. The patents were for some of the underlying systems that are related to wireless communications, the frequency bands, and other mobile networking technologies.

The lawsuit is technically targetting the way that the iPhones use multiple cellular networks. This includes both 4G LTE and 5G networkings. While it is not specifically mentioned, the lawsuit is also targetting the Apple Watch and iPad, as these products are presumed to fall under the claims of the infringement as the company’s other cellular enabled gadgets. At the moment, the complaint is asking for a jury trial and demands that the company pay for the damages, cost and other expenses related to the infringement of the patents. This also includes paying their attorney fees and ongoing royalties as well.

Apple and Broadcom have joined hands and are trying to overturn the results of their legal battles with Caltech over its WiFi patent trials from back in January 2020. The companies are asking courts to overturn the decision, which has fined both companies over 1.1 billion US Dollars in fines.

A new filing made by the Cupertino based giant and Broadcom earlier this week, has urged the court to overturn the results of the Caltech WiFi patent trials. As per an AppleInsider report, the brief suggests that the original trial was conducted with “”multiple legal errors.” Back in January 2020, the patent trial ruling had found both Apple and Broadcom guilty of infringing on patents owned by the California Institute of Technology for WiFi. Notably, Apple tried to invalidate the patent back in March, but ultimately failed.

For those unaware, Caltech’s lawyers even argued that a hypothetical licensing deal in 2010 for the chips used in iPhones, iPads, Macs, Apple Watches, and more would have brought in some 1.4 US Dollars per device from Apple and 26 cents each from Broadcom during the trial. When calculated, this figure translates to the jury applying an 838 million US Dollars fine on Apple and 270 million US Dollars on Broadcom.

In the appeal, both companies stated that “These rulings unfairly prejudiced appellants, and greatly hampered their ability to rebut Caltech’s repeated emphasis at trial on the supposed importance of the patents-in-suit, which led to an enormous — and unwarranted — damages award.” Caltech has called both firms conduct as “truly egregious” and even asked the court to raise the payment up to 2.2 billion US Dollars, after taking the lawyers and damages into account.

Earlier this week, Apple faced a fine of 10 million Euros (roughly 12 million US Dollars) in Italy after it was found to have misled consumers regarding this water resistance feature on iPhones. Now, the company is facing an additional set of lawsuits regarding its infamous “batterygate” practice.

For those unaware, the term “batterygate” is used to describe manufacturers intentionally slowing down or throttling the performance older phones. This is apparently done to preserve system stability of older devices running newer firmware, but the practice has come into question in recent years. The Cupertino based giant previously payed 113 million US Dollars in settlements to consumers over fraud allegations in the US for this practice for its iPhone 6, iPhone 7, and iPhone SE models.

And now, a total of five European consumer organizations have filed another set of class actions lawsuits against Apple in Belgium and Spain. These allegations are over the similar planned obsolescence issue, and claims that iPhone 6 and iPhone 6s models are now facing intentional slowdowns as well. Furthermore, the lawsuit is asking the company to compensate customers affected by this issue with “at least €60 (around $70) per device” in both countries while additional lawsuits are being planned in Italy and Portugal.

Apple has always denied the claims of batterygate lawsuits and said that it only reached a settlement to pay up its users to “avoid burdensome and costly litigation.” In other words, the settlements were just to remove the case and not to deal with the issue. Earlier this year, the company even paid out 25 US Dollars to each of its US customers over the identical issue for the iPhone 6. So, we will have to wait and see how the company responds to this matter.

Apple has just been hit by another lawsuit. This legal action arrives after a woman filed a lawsuit against the Cupertino based giant for hosting gambling apps, on which she spent thousands of dollars for in game currency.

Earlier this week, the lawsuit was filed in the U.S. District Court for the District of Connecticut, which claimed that Apple “promotes, enables, and profits” from gambling games on the App Store. The case was against the free to play games in the app store, which is allegedly considered illegal gambling. The plaintiff, Karen Workman, stated that she downloaded the app called “Jackpot Mania” back in 2017.

Since then she “began purchasing coins through the app so he/she could continue to play for a chance to win free coins that would enable him/her to enjoy the game(s) for a longer period of time.” Just six months prior to the lawsuit being filed, Workman had spent over 3,312 US Dollars on in game currency. The argument being presented here is that apps with in game currency also fall under the “gambling” category, which is banned on the App Store.

According to an AppleInsider report, the lawsuit alleged that the game is still considered if the users have “the ability to win and therefore acquire more playing time.” It further argues that credits that are “recorded and allow one to extend play” are a thing of value.” Furthermore, the complaint also read that “Apple is not some minor or incidental participant in these illegal gambling games. It is the principal promoter and facilitator of the illegal activity. Apple maintains dictatorial control over what apps can be downloaded from the App Store, and the payment method to purchase in-app items.”

At the moment, the lawsuit is seeking a class status and has also asked for a whole refund of “all money paid through the illegal gambling games described herein.” This payout would also include the attorney’s fees and an award for the plaintiff for “his/her services in this case on behalf of the class.” That is all we have to go on for now, and we’ll add more updates to the story, so stay tuned.

Earlier this week, the United States International Trade Commission announced that it is launching an investigation regarding an alleged infringement of Maxwell patents by Apple products. Despite hitting a 2 trillion US Dollar in market value, the company is still facing various lawsuits and allegations.

For those unaware, Maxwell is a Japanese company that makes consumer electronics products. It had filed a lawsuit against the Cupertino based giant earlier this year and even filed a complaint with the ITC. Maxwell sought for ITC to issue an exclusion order along with a cease and desist order as well. This would essentially prohibit Apple from importing devices that carry infringed technology into the US.

Just days after US company Apple filed a lawsuit against Qualcomm in a US court seeking $1 billion in damages, the Silicon Valley company has also filed a second lawsuit against Qualcomm but in China. Apple filed the suit seeking 1 billion yuan ($145.32 million) in damages in Beijing’s Intellectual Property court, a court statement indicates.

Qualcomm has been facing series of litigations and fines as a result of its model of transacting business with its partners of which Samsung and Apple are the two largest, accounting for up to 40% of Qualcomm’s revenue in recent times. Qualcomm supplies both companies modem chips which connect phones to wireless networks. Apple is accusing the chip maker of abusing its dominance of the chip industry and is further seeking compensation for damages. Specifically, Apple is accusing Qualcomm of failing to live up to promises made to license “standard essential patents” broadly and inexpensively.
