Smartphone maker Apple and chipset manufacturer Qualcomm has announced that the companies are settling their lawsuits.</p>
<p>Effective immediately, all litigation between the two companies has been dropped, and the companies have signed a new patent license and chip supply agreements. The companies have not shed light on the details as the agreement is largely a private matter.</p>
<p>The settlement includes a payment from Apple to Qualcomm as well as a chipset supply agreement, suggesting that Apple will buy Qualcomm chips for future iPhones. However, the companies did not say how much the payment will be.</p>

<p>It seems that Apple will be making a one-time payment to Qualcomm to cover any IP use since Apple cut off payments to Qualcomm in 2017. Apple has also signed a 6-year patent license agreement with Qualcomm, which is being backdated to April 1st. The agreement includes a further 2-year extension option, which if Apple eventually chooses to exercise it, would take the agreement through April 2027.</p>
<p>Apple will also resume buying chips from Qualcomm. The companies have also signed a separate chipset supply agreement and the official announcement doesn’t say for how long beyond the fact that it’s a “multiyear” agreement. This suggests that the Qualcomm is once again going to be supplying modems for Apple’s iPhones and iPads.</p>
<p>Soon after the announcement went public, <a href="https://www.gizmochina.com/tag/intel">Intel</a> announced that it is exiting the 5G smartphone modem business. However, the company said that it will continue to invest in its <a href="https://www.gizmochina.com/tag/5g/">5G</a> network infrastructure business. It&#8217;s noteworthy that Intel was the sole supplier for iPhone modems last year but the recent report said that Apple had concerns about Intel’s ability to supply next year’s iPhone models with 5G modems.</p>

<p>After the news about settlement broke, Qualcomm&#8217;s stock rose more than 20 percent, boosting its market cap by about $14.5 billion to more than $84 billion. This seems to be Qualcomm&#8217;s best day since 1999. Further, Apple was up less than 1 percent but Intel sharply dipped.</p>

<p>While Apple is working to reverse the ban, the company is reportedly planning to work on implementing hardware changes to some of its higher-selling devices in order to continue their sales in the Germany market.</p>
<p>According to the report, Apple is currently examining the possibility of creating a slightly modified version of the iPhone 7 and iPhone 8 models in Germany. Aside from software changes, the models will apparently have an infringing component pulled from the design and replaced with another.</p>

<p>The components, which was the cause of the injunction, were produced by Apple supplier Qorvo, and are alleged to have violated an &#8220;envelope tracking&#8221; patent held by Qualcomm. This is related to a method of conserving battery power while the modem is active.</p>
<p>If the report turns out to be true, then this would provide Apple not only a way to continue selling its popular iPhone models in Germany, but also without having to pay Qualcomm a patent licensing fee for the freshly-produced models.</p>
<p>As per the ruling in Germany, iPhone 7 and iPhone 8 models will not be sold in its 15 retail stores in Germany. Notably, it does not include new iPhone models such as iPhone XS, <a href="https://www.gizmochina.com/product/apple-iphone-xs-max/">iPhone XS Max</a>, and iPhone XR.</p>
<p>At that time, in a statement, <a href="https://www.gizmochina.com/tag/apple/">Apple</a> said, <em>“We are of course disappointed by this verdict and we plan to appeal. All iPhone models remain available to customers through carriers and resellers in 4,300 locations across Germany.”</em></p>
<p>The German case is the chipset maker’s third major effort to secure a ban on Apple’s lucrative iPhones over patent infringement allegations. The company had earlier filed such cases in the United States and in China. It was also Qualcomm’s second major win against Apple after a <a href="https://www.gizmochina.com/2018/12/11/qualcomm-case-court-barred-apple-from-importing-older-iphones-in-china/">Chinese court granted an injunction against Apple</a> for an alleged patent violation earlier this month.</p>

<p>Following the ruling in the Apple-Qualcomm patent case, Apple will now stop selling iPhones in its stores in Germany that use chips from Intel and parts from another supplier named Qorvo.</p>
<p>The judge has ruled that phones that contain a combination of chips from Intel and Apple supplier Qorvo violated one of <a href="https://www.gizmochina.com/tag/qualcomm/">Qualcomm</a>&#8216;s patents around envelope tracking that helps mobile phones save battery power while sending and receiving wireless signals.</p>

<p>In a statement, Apple said that it is planning to appeal the ruling. Under this condition, Judge Matthias Zigann told the ruling would not go into immediate effect. However, Apple said that throughout the appeal process, iPhone 7 and iPhone 8 models will not be sold in its 15 retail stores in Germany.</p>
<p>The company&#8217;s new iPhone models, including iPhone XS, <a href="https://www.gizmochina.com/product/apple-iphone-xs-max/">iPhone XS Max</a>, and iPhone XR, will still be sold in those stores. However, the company has clarified that all iPhone models, including iPhone 7 and 8 will still be sold through carriers and other third-party retailers in Germany.</p>
<p>In a statement, <a href="https://www.gizmochina.com/tag/apple/">Apple</a> said, <em>&#8220;We are of course disappointed by this verdict and we plan to appeal. All iPhone models remain available to customers through carriers and resellers in 4,300 locations across Germany.&#8221;</em></p>
<p>On the other hand, Qualcomm said in a press release that the injunction will be in effect as soon as it posts the required bonds. The company added that it would complete the process &#8220;within a few days.&#8221; Don Rosenberg, executive vice president and general counsel, Qualcomm Incorporated, said:</p>
<blockquote><p>Two respected courts in two different jurisdictions just in the past two weeks have now confirmed the value of Qualcomm’s patents and declared Apple an infringer, ordering a ban on iPhones in the important markets of Germany and China.</p></blockquote>
