<p>The plaintiff who is an actress and environment activist had contended that the 5G rollout would result in irreversible damage to the environment and &#8220;no person, animal, bird, insect, and plant on earth will be able to avoid exposure, 24 hours a day, 365 days a year, to radiation 10x to 100x times greater than what exists today.&#8221;</p>
<p>However, the Delhi high court which heard the case has thrown out the lawsuit today. The trial judge chastised the plaintiff and described the lawsuit as meant to seek publicity. The court also dismissed the suit and awarded a cost of ₹ 20 lakh (around $27,000 USD) against the plaintiff for abuse of the court process.</p>

<p>The court proceeding was brought with several dramas as a result of the huge sensation it generated, apparently due to the spiking COVID 19 cases in India. The court proceeding on Wednesday was interrupted severally despite being a virtual hearing. That is because the actress had shared the link on Twitter and Instagram. Several of the participants in the session who joined using the link shared on social media sang songs from the actress&#8217; movies, thereby disrupting the proceeding. The infuriated judge had to order the Delhi police to fish out the disruptors and to take action against them by issuing a contempt notice.</p>
<p>The COVID 19 pandemic afforded conspiracy theorists another opportunity to campaign against 5G towers across different cities. Even in developed nations like the UK, there were reports of conspiracy theorists <a href="https://www.gizmochina.com/2020/04/06/5g-towers-in-the-uk-are-being-burned-by-conspiracy-theorists/">burning down a 5G tower</a> as a result of false claims that the COVID 19 pandemic is linked to radiation emitted from 5G cell towers.</p>

<p>For those unaware, the Chinese tech giant has allegedly infringed on technology patents that were owned by Philips, the known consumer electronics maker, who is now seeking to restrain the former from manufacturing, assembling, importing, selling, offering for sale, advertising and selling on third party websites that include any UMTS enhancement (HSPA, HSPA+) and LTE technologies, which infringe on Philips&#8217; patents, as per a <a href="https://www.livemint.com/news/india/philips-moves-hc-to-restrain-xiaomi-from-selling-phones-infringing-tech-patent-11606802225176.html" target="_blank" rel="noopener noreferrer"><em>LiveMint</em> </a>report.</p>

<p>At the moment, the court has directed Xiaomi and other defendants to maintain their bank accounts operated in India, with a balance of 1,000 crores (roughly <span class="DFlfde SwHCTb" data-precision="2" data-value="135802210">136 million US Dollars). According to the court order passed on 27th November 2020, &#8220;It is made clear that the defendants are bound by the statement given by their counsel. The defendants shall file the details of the bank accounts operated in India where the amount of <span class="webrupee">₹</span>1,000 crore is being maintained, on or before 2 December 2020.&#8221;</span></p>

<p>The next date of hearing for the matter is on 18th January 2021. Philips also sought an ad-interim order of injunction be granted directing the Central Board of Excise and Customs to issue instructions to custom authorities at every port in India. In other words, the company is seeking to stop the import of Xiaomi smartphones, especially those that infringe on its patented technology.</p>

<p>The company is now all set to launch the Asus <a href="https://www.gizmochina.com/product/asus-zenfone-6/">Zenfone 6</a> in India and ahead of the launch, Asus is now entangled in some legal issues. The Delhi High Court has ruled that Asus has infringed on an existing trademark for the word Zen, which belongs to Telecare Network.</p>

<p>Telecare Network India Pvt Ltd, which claims to own the trademarks for Zen and Zen Mobiles had filed the case against <a href="https://www.gizmochina.com/tag/asus">Asus</a>. The company sells feature phones as well as entry-level smartphones under this brand name and has claimed that the use of a similar branding by a competitor is damaging.</p>
<p>The Delhi High Court found these claims reasonable and restrained Taiwan-based Asus from selling any smartphone, tablet, or accessory with the ZenFone branding starting eight weeks after May 28th, i.e. July 23rd.</p>
<p>Telecare also claims that Asus used the Zen name to &#8220;ride upon its goodwill&#8221; when the company entered the Indian market back in the year 2014. On the other hand, Asus says that the word &#8220;zen&#8221; is common and has its roots in Buddhism.</p>
<p>However, Asus has appealed this decision and the next hearing is scheduled to take place on 10th July. So, either the company needs to win the next hearing or needs to change the branding for its smartphones in India.</p>

<p>As said, this comes just ahead of the launch of the Zenfone 6 smartphone in India, which is <a href="https://www.gizmochina.com/2019/05/31/asus-zenfone-6-likely-to-launch-on-june-16-in-india/">expected to take place on 16th June</a>. It remains to be seen if this legal issue will impact the launch scheduled of the company&#8217;s flagship smartphone in one of the world&#8217;s biggest smartphones market.</p>
