<p>The Indian <a href="https://www.gizmochina.com/tag/government/" target="_blank" rel="noreferrer noopener">government</a> is considering the new rules to ensure that pre-installed apps are not weak security points that could be exploited by foreign nations, including <a href="https://www.gizmochina.com/tag/china/" target="_blank" rel="noreferrer noopener">China</a>, said a senior government official. The government has ramped up scrutiny of Chinese businesses since a 2020 border clash between the two nations, banning more than 300 Chinese apps, including <a href="https://www.gizmochina.com/tag/TikTok/" target="_blank" rel="noreferrer noopener">TikTok</a>.</p>



<p>Under the new rules, smartphone makers will have to provide an uninstall option for pre-installed apps, and new models will be checked for compliance by a lab authorized by the Bureau of Indian Standards agency. The government is also considering mandating screening of every major operating system update before it is rolled out to consumers.</p>



<p>India&#8217;s fast-growing smartphone market is dominated by Chinese players, with Xiaomi, Vivo, and Oppo accounting for almost half of all sales, while Samsung has a 20% share and Apple has 3%. The companies and India&#8217;s IT ministry have not responded to a Reuters request for comment.</p>



<p>However, the new rules could pose challenges for smartphone manufacturers, particularly for those that sell their devices with proprietary apps or pre-install others with which they have monetization agreements. Some industry executives have expressed concerns that more testing could prolong approval timelines for <a href="https://www.gizmochina.com/tag/smartphones/" target="_blank" rel="noreferrer noopener">smartphones</a> and hinder a company&#8217;s go-to-market strategy. Nonetheless, the Indian government has decided to give smartphone makers a year to comply with the new rules once they come into effect, the date for which has not been fixed yet.</p>

<p>At the inaugural session, Information and Broadcasting Secretary, Apurva Chandra, highlighted the significance of this issue for the future of journalism. Minister of State, Ministry of Electronics &amp; Information Technology, Rajeev Chandrasekhar also emphasized the importance of this issue, highlighting the financial struggles of both the digital and parent print news industries post-Covid. Chandra stated that with the growth of the news industry, it is crucial that digital news platforms receive fair compensation from BIG TECH platforms for their original content.</p>



<p>The Digital News Publishers Association (DNPA) is a group comprising 17 of the nation&#8217;s leading news publishers. Chandra further emphasized the significance of ensuring the stability of the traditional news industry. He acknowledged the challenges of keeping up with advancements in technology and the resulting questions about the governance of a large democracy, the changes in the news publishing industry, and their impact on business and citizens&#8217; lives. Expressing his optimism that the DNPA’s conclave will yield valuable suggestions specific to India, he also affirmed that the government would act in the best interest of all.</p>

<p>The order, issued by the Computer Emergency Response Team (CERT-in), which is a department under the Ministry of Electronics and IT requires these companies to collect sensitive user data like IP addresses, usage patterns, etc, and store it for up to 5 years before eventually handing it over to the government whenever asked. Failing to comply with these orders can result in prison sentences of up to a year under Section 70B(7).</p>
<p>The government has stated that this move is aimed at “coordinate response activities as well as emergency measures with respect to cyber security incidents.”</p>

<p>As you can imagine, this is a direct step against data privacy. And it appears that major VPN companies operating in India are unlikely to comply with these orders according to recent statements issued by them.</p>
<p>Laura Tyrylyte, who is the security spokesperson for NordVPN said “We are committed to protecting the privacy of our customers, therefore, we may remove our servers from India if no other options are left.”</p>
<p>Express VPN also issued a statement saying “VPNs are critical for user safety and the preservation of user’s right to online privacy and are fundamentally opposed to any efforts to undermine such technologies.”</p>
<p>Shurfshark VPN&#8217;s legal head Gytis Malinauskas has said that “We operate only with RAM-only servers, which means that at this moment, even technically, we would not be able to comply with the logging requirements.</p>
<p>Going by the statements of these major VPN service providers and their firm stance against the Indian Government&#8217;s mandate, it could be possible that these companies might soon stop providing their services in India. The last date for complying with the CERT-in&#8217;s directive is June 27th, 2022, so stay tuned for more updates on the matter.</p>

The government is now asking VPN based companies to collect and provide it with user data.</p>

<p>According to an <a href="https://entrackr.com/2022/04/it-ministry-orders-vpn-providers-crypto-players-to-store-user-data-for-five-years/" target="_blank" rel="noopener noreferrer"><em>Entrackr</em> </a>report, the government wants Virtual Private Network firms to collect the user&#8217;s data for five years on their servers and then eventually hand it over to the government. This order is not limited to just VPN based companies and even targets Cloud and Crypto based firms as well. The report adds that firms that do not comply with this order may face prison sentence up to a year under the Section 70B(7). This order has been issues by a department under the Ministry of Electronics and IT, which is known as Computer Emergency Response Team (CERT-in).</p>
<p>The department has urged VPN companies to collect sensitive user data, which includes their customer&#8217;s names after validating them. Furthermore, they would even have to store other forms of information of the user like their IP addresses, usage patterns, and even other forms of identifiable information as well. All in all, the IT Ministry department stated that these efforts are being made to &#8220;coordinate response activities as well as emergency measures with respect to cyber security incidents.&#8221; However, this is a major step against data privacy since companies are now legally allowed and required to collect and store your data as per the new order.</p>

<p>The VPN, cloud, and crytpo based firms will begin collecting data starting from the date of 27th June 2021. So, the process is already underway. Unfortunately, many firms might face difficulties (especially VPN firms) that advertise their services with a no logs policy. Additionally, VPN users typically use the service to hide their original IP address and online footprint. This even helps in hiding their IP addresses from malicious individuals like hackers. So, collecting such user data defeats the purpose and makes data leaks more likely in the near future.</p>

										<content:encoded><![CDATA[<p>The Enforcement Directorate (ED), which is a central probe agency in India, has confirmed that it has seized assets worth around $725 million (₹5,500 crore) from Chinese giant <a href="https://www.gizmochina.com/tag/xiaomi">Xiaomi</a> over violations of the Indian foreign exchange law.</p>
<p>While the agency has taken action against Xiaomi Technology India Private Limited, the company, which does <a href="https://www.gizmochina.com/tag/business">business</a> in India under the Mi brand is claiming that all its operations &#8220;are firmly compliant&#8221; with the local laws and regulations.</p>

<p>The Enforcement Directorate has said that it had seized the sum from the bank accounts of Xiaomi Technology India Pvt. Ltd, a wholly-owned subsidiary of Xiaomi Inc., under the Foreign Exchange Management Act (FEMA), 1999.</p>
<p>The agency is claiming that the subsidiary had been making remittances to three foreign entities, one of which was a Xiaomi entity, “on the instructions” of its Chinese parent. It has been probing the company since February over alleged forex violations. It <a href="https://www.gizmochina.com/2022/04/13/india-financial-crimes-watchdog-xiaomi-india-head-manu-jain/">had also questioned</a> Xiaomi’s Global Vice President Manu Kumar Jain last month, who was also the Indian head of the company.</p>
<p>In a statement, the agency said that <em>&#8220;Xiaomi India procures completely manufactured mobile sets and other products from the manufacturers in India. Xiaomi India has not availed any service from the three foreign-based entities to whom such amounts have been transferred. Under the cover of various unrelated documentary façades created amongst the group entities, the company remitted this amount in the guise of royalty abroad which constitutes a violation of Section 4 of the FEMA. The Company also provided misleading information to the banks while remitting the money abroad.&#8221;</em></p>
<p>Countering the claims made by the Enforcement Directorate, Xiaomi India said in a statement that <em>&#8220;these royalty payments that Xiaomi India made were for the in-licensed technologies and <a href="https://www.gizmochina.com/tag/ip">IPs</a> used in our Indian version products. It is a legitimate commercial arrangement for Xiaomi India to make such royalty payments. However, we are committed to working closely with government authorities to clarify any misunderstandings.&#8221;</em></p>
<p>Last year, the premises of Xiaomi and a few other Chinese mobile manufacturing companies were raided across the country by the Income Tax Department on the charges of tax evasion. Xiaomi continues to lead the Indian <a href="https://www.gizmochina.com/tag/market-share">smartphone market</a> with around 22 percent market share in Q4 2021.</p>
