<p>It is believed that overseas suppliers of chip-making equipment are involved. The US Commerce Department’s Bureau of Industry and Security (BIS) has already beamed its searchlight on PXW. The BIS, in a statement released, says it is on the lookout for efforts to export controls for companies like Huawei on the Entity List. The PXW manufacturing facility is within the vicinity of Huawei’s headquarters and this has been established with satellite images and public records.</p>
<p>PXW will be restricted in what chip-making equipment it can buy from US suppliers or other overseas companies that deploy American technology in their equipment. The company plans to begin production of chips using the 28nm process in 2025.</p>
<p>Huawei has endured a tortuous time since the US sanctions kicked in at the height of its global dominance. It was previously the world’s largest supplier of mobile communications equipment and a leader in pioneering 5G technology. The US allegations center on espionage and the Chinese company has continued to deny the claims.</p>

<p>In a statement to Agence France-Presse (via <a href="https://www.scmp.com/news/china/article/3165348/huawei-takes-sweden-court-after-nordic-country-bans-chinese-tech-giants">South China Morning Post</a>), the Chinese company said, &#8220;The Swedish authorities’ decision to discriminate against Huawei and exclude it from the 5G roll-out has significantly harmed Huawei’s investment in Sweden, in breach of Sweden’s international obligations.&#8221;</p>

<p>As a result, Huawei had to initiate arbitration proceedings under the World Bank Group’s International Centre for Settlement of Investment Disputes (ICSID) &#8220;against the Kingdom of Sweden following a number of measures taken by the Swedish authorities targeting directly Huawei’s investments in Sweden and excluding Huawei from the roll-out of 5G network products and services in the country.&#8221;</p>
<p>Sweden has become the second country in Europe following the UK, and the first in the EU, to ban network operators from using Huawei equipment in their 5G products. The country has ordered Huawei to remove equipment that&#8217;s already been installed by January 1, 2025.</p>
<p>Huawei did not specify the damages it was seeking but it&#8217;s reported by broadcaster SVT that the initial sum stood at 5.2 billion Swedish Kroner ($550 million), although it could end up reaching much higher.</p>
<p>The ban has strained Swedish-Chinese relations, with Beijing warning earlier that it could have &#8220;consequences&#8221; for the Nordic country&#8217;s companies in China.</p>

<p><span style="font-weight: 400">The Swedish court upheld a ban on Huawei from selling 5G equipment in Sweden. Huawei had appealed the October 2020 ban of the company by Sweden&#8217;s telecoms regulator due to security concerns. This is the second appeal that Huawei would be losing in its pursuit to overturn the regulator&#8217;s decision. </span></p>
<p><span style="font-weight: 400">The ruling by the court affirms the need to safeguard the security of Sweden, which is of heavy importance and should be sustained. It was unlikely that Huawei would have gotten a reprieve from the Administrative court after the first Appeal in December was dismissed. </span></p>
<p><span style="font-weight: 400">Huawei continues to insist that it is being targeted unfairly on false suspicion of links to the Chinese government. It says it is disappointed with the verdict and would still pursue other legal options open to it. </span></p>
<p><span style="font-weight: 400">Sweden is not the only country in Europe that has restricted Huawei from participating in 5G equipment rollout. Huawei had hoped that its appeal would have led to the upturning of the decision by Sweden&#8217;s Post Telecom Authority to ban it from participating in the 5G rollout in the country. Huawei remains the global leader in 5G but it has been unable to wriggle itself away from the suspicion of being owned by the Chinese government. </span></p>
<p><span style="font-weight: 400">Huawei says it is currently studying the judgment and the court&#8217;s justification to determine whether to explore further legal remedies it may use to protect its legitimate interests. It says it is open to constructive dialogues with the parties involved for an amicable resolution of the issue in a practical manner. Huawei says it is willing to work with the regulatory body and other stakeholders to mitigate any security concerns that led to the initial blocklisting of the company. </span></p>
