Huawei Technologies, the Chinese telecommunications giant, has taken legal action against the Spanish government’s recent regulations, potentially excluding the company from receiving state aid in the development of 5G networks. According to the contentious rules, critical components of 5G networks, such as equipment, components, and associated software, should not be sourced from suppliers labeled as “high risk” by Spain. Additionally, operators who have already deployed 5G technology might face equipment replacement if their supplier falls under the high-risk category. However, the Economy Ministry, responsible for formulating these rules, has yet to finalize the list of banned suppliers, leaving the telecom industry in suspense.

Huawei contends that the regulations impede operators’ freedom to choose suppliers based on objective criteria encompassing commercial, technical, and security requirements. Instead, the company claims the rules attempt to exclude certain suppliers based on what it perceives as arbitrary political criteria.

This legal challenge unfolds against the backdrop of the European Commission’s mounting pressure on member states to phase out Huawei and ZTE Corp. equipment from their advanced mobile networks. The EU, citing security concerns, prohibited the use of these vendors’ equipment in its internal systems, intensifying scrutiny on nations relying heavily on Chinese equipment, including Germany and Spain.

As of December 2022, a report by Strand Consult revealed that 38% of Spain’s 5G network was supplied by a Chinese vendor, underscoring the significant stakes involved. This legal battle in Spain closely follows Huawei’s appeal in Portugal against a decision made by the country’s cybersecurity council, which forbids operators from utilizing Huawei’s equipment in the construction of 5G mobile networks.

However, following scrutiny sparked by the US, the Chinese tech giant was banned from telecom networks in certain regions. Furthermore, the US sanctions had even impacted its telecom operations as well. But, it appears that the company is still licensing its 5G tech expertise to other brands. A new report stated that Huawei announced a cross licensing deal with Oppo, which includes standard essential patents (SEP) for 5G networking.

According to Adler Fend, Oppo’s Chief Intellectual Property Officer We are very pleased to enter into patent cross-licensing agreement with Huawei. It clearly demonstrates that the two companies recognize and greatly respect the value of each other’s intellectual property. It is a win-win deal for both sides. We will, as always, advocate for the establishment of a sustainable, healthy intellectual property ecosystem, where intellectual property licenses can be resolved through amicable negotiations and every company’s patent value are highly respected.”

The company is also licensing key 5G technologies to Samsung as well. A Weibo tipster has revealed that Huawei could launch a 5G phone case that will enable 4G devices to transit to 5G connectivity. Currently, Huawei devices do not support 5G connectivity due to chip restrictions. The new technology could prove very important although the optics and performance capability of the system has not been established.

A chipset that supports 5G will trump the use of a 5G phone case inside a 4G-enabled device, but this could provide better performance than 4G. There is no official confirmation yet from Huawei on the rumored 5G phone cover and we do not have any release details yet. The Weibo tipster also stated that the rumored 5G phone case will indeed be less efficient than an integrated 5G chipset.

An image of the rumored Huawei 5G phone case was also shared by the tipster. It shows a large camera cutout that bears a striking semblance with the P50 series, The case also has a base gradient finishing on its rear side. The phone case, as per the render, has network bands on all sides meaning that it could indeed perform better than a regular P50 case for example.

Huawei on Sunday said that it initiated arbitration proceedings against Sweden under the World Bank Group after the country banned the Chinese tech giant from releasing 5G products.

In a statement to Agence France-Presse (via South China Morning Post), the Chinese company said, “The Swedish authorities’ decision to discriminate against Huawei and exclude it from the 5G roll-out has significantly harmed Huawei’s investment in Sweden, in breach of Sweden’s international obligations.”

As a result, Huawei had to initiate arbitration proceedings under the World Bank Group’s International Centre for Settlement of Investment Disputes (ICSID) “against the Kingdom of Sweden following a number of measures taken by the Swedish authorities targeting directly Huawei’s investments in Sweden and excluding Huawei from the roll-out of 5G network products and services in the country.”

Sweden has become the second country in Europe following the UK, and the first in the EU, to ban network operators from using Huawei equipment in their 5G products. The country has ordered Huawei to remove equipment that’s already been installed by January 1, 2025.

Huawei did not specify the damages it was seeking but it’s reported by broadcaster SVT that the initial sum stood at 5.2 billion Swedish Kroner ($550 million), although it could end up reaching much higher.

The ban has strained Swedish-Chinese relations, with Beijing warning earlier that it could have “consequences” for the Nordic country’s companies in China.

Progress was much faster than we expected, especially in terms of subscriber base, network coverage, and the sheer number of 5G terminals on the market.” The senior official made the statement during the Chinese tech giant’s 12th annual Global Mobile Broadband Forum earlier this week.

Notably, the call for cooperation arrives after 5G networking has seen five years of commercial deployment. As of right now, there are currently 176 commercial 5G networks around the globe that offer services to more than 500 million customers. Furthermore, the average download speeds of the latest generation of networking is roughly 10 times faster than 4G network, which has had a positive impacts in various fields.

At the moment, the enterprise market already has over 10,000 projects that are exploring B2B applications of 5G. This includes the manufacturing, mining, and ports businesses that have passed the trials, which are fields Huawei has recently been shifting its focus towards. Hu further added that “Right now more than half of these 10,000 5G to B (5G to business) projects are in China. We have a huge number of use cases already, but we need to build more sustainable business cases.”

Earlier this month, Huawei stated that it had filed an appeal against a ruling by a Swedish court back in June 2021. The initial ruling upheld the ban of sale of the company’s 5G telecommunications equipment.

For those unaware, back in January 2021, Supreme Administrative Court of Sweden had dismissed an appeal by Chinese tech giant against its exclusion from the country’s 5G network rollout. The company’s equipment was banned from Sweden’s network and the sale of its 5G gear was also prohibited. The primary reason for the ban was to safeguard the security of Sweden. Huawei insisted that it is being targeted unfairly on false suspicion of links to the Chinese government.

In June, it faced another blow in the region as the court dismissed its second appeal as well. Now, the company has filed another appeal stating that it has requested an oral hearing in the case. Although, the Court of Appeal can decide whether such a hearing should be held or a preliminary ruling from the European Court of Justice should be requested. This marks another region in Europe where the company is facing a ban.

Furthermore, the situation is made worse by the US legalization against Huawei and ZTE telecom infrastructure in Europe. This move from the US seeks to provide support and funds to its allies in the Eastern Europe that are vulnerable to low cost telecom equipment from these Chinese firms. Meaning, the company is facing increased tensions and scrutiny in the west, as the US continues to pressure its allies to ban Huawei.

The biggest player in the 5G race is the controversial figure Huawei. China issued the China Mobile 2021 4G/5G Fusion Core Network Procurement tender in order to invite bidders and it turns out that the highest bidder was Huawei. This is not the first time the 5G giant has backed such a big tender. In fact, it was obvious even before the bidding as Huawei would turn out to be the highest bidder, the next closest rival is ZTE.

Earlier this year, Huawei bagged its first 5G 700MHz main equipment collection tender of a total of 38 billion tenders. This makes the recent win the second-largest 5G list this year. The budget for Huawei’s Core Network purchase also seems pretty overwhelming at a whopping 7.5 billion Yuan.

However, this is only the first time for Huawei where they’ve won the first bid share. But all this was expected as Huawei is the biggest player in the 5G equipment and core network. The price breakup of the deal is such that Huawei equipment is quoted at 6,406.25 million Yuan and a service quotation of 1,082.44 million Yuan. China Mobile set a maximum bid limit of 6,737 million Yuan for the equipment portion of the tender and for the Edge UPF portion, it was set at 798.7 million Yuan. This adds up to a maximum big limit of more than 7.5 Billion Yuan and Huawei’s quote matches this highest bid limit.

The lack of competitors also gave an edge to Huawei as only the big two, ZTE and Huawei were competing to bag the deal. And considering the capabilities and cap of Huawei, it was expected that Huawei will bag most of the shares, followed by ZTE. The two companies had a mutual understanding between them and both of them would be enjoying the tenders they have bagged.

The company’s focus on these emerging markets arrives as the US has urged various nations to exclude the brand from their fifth generation of wireless networks (5G). The US had cited national security concerns against the company, especially to governments in the West like the UK and certain European nations.

Despite this, Huawei still has a strong presence in the emerging markets in Africa and the Middle Eastern regions. As of right now, the equipment made by the company is around 20 to 30 percent more affordable than those made by its European competitors like Ericsson and Nokia. Furthermore, the telecom equipment maker has also not given up on expanding its presence in developed nations, although, it is focusing more on emerging markets.

For those unaware, Huawei is a major player in the telecom industry and supplies its networking gear to many countries across the globe. Earlier this week, Huawei unveiled a series of new 5G products and related solutions at the Mobile World Congress 2021 (MWC) in Barcelona. The products were under its “1+N” plans and seek to expand its existing portfolio of networking based technology.

During the conference, the Chinese telecommunications giant stated that it has put together its leading algorithms and technology along with ultra wideband radio to launch the industry’s only Massive MIMO product. This supports 64T64R and 400 MHz bandwidth and is the first of its kind in the world, as claimed by the brand. The new product also supports the entire C band, which would enable operators to deploy their multi-segment spectrum on just one module to reduce the number of devices.

Furthermore, Huawei also highlighted that the 64T64R Massive MIMO is also the lightest of its kind as well. The company also showcased that it is a light weight base station that is easy to install and even takes up less space, which contributes to its lower construction cost. A single module weighs as little as 19 kilograms and can be installed by just one person while also delivering on performance. Other notable aspect regarding the new 5G product is that it is the industry’s only 64T A+P Solution and is also the only unit that supports three low and three medium bands.

The solution is also the only commercial FDD massive MIMO in the market as well. Yang Chaobin, President of Huawei Wireless Product Line, stated that “By launching this series, we aim to bring multi-antenna technology to all scenarios and bands. After the UK government banned the use of telecommunications equipment made by Huawei, the company faced a noticeable decline in its profits and revenue in the region.

For those unaware, equipment made from the Chinese tech giant was banned by the local government from being used in the country’s 5G networking infrastructure. This meant that local telecom operators can no longer source telecommunications equipment from the company. Furthermore, the government also mandated that carriers have to phase out any equipment from the Chinese brand completely by the year 2027. Meaning, Huawei is essentially cut off from the 5G network in the UK.

According to an FinancialTimes report, a source stated that the company’s sales in 2020 were down by 27 percent year on year, reaching just 913 million Pounds (roughly 1.28 billion US Dollars). On the other hand, the company’s operating profit was down to a quarter, amounting to just 36.4 million Pounds (roughly 51.3 million US Dollars) before tax. Although, the vendor’s profits did benefit from a 26 million Pounds in costs due to the reduction in employee and travel expenses during this time.

While the UK unit of Huawei is a relatively small division of the company, it is also a symbol of the struggles that the brand is facing in various countries. After placing various sanctions on the telecom equipment maker, the US government also pressured other nations, including the UK, to ban the company from supplying gear for core 5G networks. Brendan Carr, the FCC Commissioner, is looking to keep the restrictions tight against Chinese 5G equipment makers like Huawei and ZTE. Under the previous Trump administration, these firms were branded as national security threats due to alleged ties with the Chinese Communist government.

For those unaware, the US even went as far as to urge its allies to also ban the use of Huawei’s networking equipment when building their 5G networking. Back in 2020, the FCC even blocked the carriers from using money from the FCC managed USF (Universal Service Fund) to buy equipment from Huawei and ZTE made networking equipment. However, the networking equipment from the two Chinese manufacturers are still used by rural carriers if it is sourced by private funds.

Thus, Carr stated that the FCC needs to close these “glaring loophole … It makes no sense to allow that exact same equipment to get purchased and inserted into our communication network as long as federal dollars are not involved.” Similarly, the President Joe Biden appointed temporary FCC Chairman Jessica Rosenworcel has also “long advocated for reforming the equipment authorization process to better ensure security in new network devices and is pleased to see growing support for this idea. The FCC is already working on addressing many of the issues Commissioner Carr spoke about,” as per an FCC spokesperson.

Commisioner Carr also stated that the organization should do more to publicize China’s abuse of ethnic and religious minorities. Furthermore, the FCC named five Chinese companies as threats the US national security under a law designed to protect the security of US networks earlier this month. Meanwhile, Huawei announced that “extending the FCC’s evaluation and approval process to prohibit equipment that is already accredited by the FCC is misguided and costly to American companies.”

This news had arrived from a government official, who believed that Huawei and ZTE might meet the eligibility criteria for the list. However, a new report from ET states otherwise as highly places sources close to the matter stated that the company is unlikely to be given approval to supply its 5G gear to telecom operators in the region.

These sources believe that the brand would likely not be included in the “trusted” list due to security concerns. For those unaware, Huawei has faced various accusations across the globe regarding its alleged ties with the Chinese government. Furthermore, the recent military clashes in the Indo-Chinese border also worsened the political tensions between India and China. This further prompted the Indian government to create a “trusted source” list to tighten its security regulations, especially in the case of telecommunications.

Thus, while it seemed like the Chinese vendor could’ve been a part of India’s 5G trials, this change in policy might not allow the company’s gear to be used by local vendors like Airtel, VI, and others. Earlier this week, Huawei Technologies revealed its royalty rate for licensing its 5G mobile technology for the first time since the company and other China based firms were designated as national security threats.

According to a SCMP report, Jason Ding, the head of intellectual property at Huawei, made the announcement and revealed its licensing push during a speech on Tuesday at an innovation forum event in Shenzhen, China. During the event, the Chinese tech giant introduced its latest intellectual property white paper as well. As per Ding, “We believe licensing should balance return on investment and cost pressures of implementation in the industry. For every phone that complies with 5G standards, we will not seek a royalty rate higher than US$2.5 per unit.”

Through this, the smartphone maker hopes that the rates “will give implementers of 5G technology a clear number they can rely on for cost estimation and investment decisions. Our goal is to promote broader adoption of 5G across all industries.” For those unaware, Huawei was placed in the trade blacklist by the Trump administration back in 2019, despite being the largest technical contributor to global 5G standards.

As per the report, the company’s revenue from patent licensing alone between 2019 and 2021 is estimated to be somewhere around 1.2 billion US Dollars to 1.3 billion US Dollars. Notably, the effort for licensing its 5G technology and generating revenue also highlights the company’s current situation as it struggles due to the various sanctions against it. The company has had restrictions ranging from access to advances chips, to even technology made in the US imposed on it.

According to a Bloomberg report, the US government has placed new restrictions regarding items that are used in or with 5G products. The new 5G ban is effective as of this week, as per people close to the matter. With the new rule, the Biden administration has created a new restriction on the export of components like semiconductors, antennas, and batteries for Huawei 5G devices. In other words, creating a more uniform ban among the licensees.

For those unaware, a few American firms had previously received licenses that allowed them to continue shipping components to the Chinese tech giant that might even be used in building their 5G equipment. Previously, the Trump administration had placed Huawei along with other Chinese companies under the trade blacklist, ‘Entity List,’ which basically required US based firms to acquire a license to trade with the brand.

Anatel, the telecom regulator of Brazil, has just recently approved the rules for a spectrum auction for 5G networks earlier this week. The auction will be set sometime later this year, and will not exclude Huawei Technologies.

For those unaware, the Chinese tech giant is a major brand in the telecommunications industry and is one of the largest suppliers of telecom equipments as well. However, it had been facing various allegations over the past year, which led it to face a ban in multiple regions across the globe. Last year, even the Brazilian President Jair Bolsonaro, had criticized the company and was also under pressure from the former Trump administration regarding a ban on the Chinese telecom provider from the nation’s 5G market.

But as per a Reuters report, the company will not face any ban in the region, despite previously being accused of being a security risk. Notably, the telecom operators in Brazil had been advocating for a free market, stating that banning Huawei would cost the companies billion of dollars to replace the equipment provided by the Chinese equipment supplier. At the moment, about 50 percent of the entire 3G and 4G networking infrastructure is supplied by Huawei.

The rules of the auction will also arrive with costly conditions, requiring telecom operators to migrate to more advanced technology with standalone networks and not based on their current technology. According to a LoopJamaica report, the specifications of the international tender for the implementation of 5G networks will not be excluding the Chinese telecommunications giant. The President of the republic, Luis Abinader, added that the implementation of the 5G network aims to boost opportunities for the citizens of the nation through connectivity. Furthermore, the newer and faster bandwidth also brings a ‘more modern and inclusive health system and streamlined public spending.’

The President further added that “We are looking for a more competitive, dynamic, more connected Dominican Republic. The implementation of the 5G network will be a great step in the history of the country’s telecommunications development, which will translate into a profound digital transformation. The winning company must implement a 5G-infrastructure deployment with national coverage at the end of five years.”

Huawei Founder and CEO, Ren Zhengfei, said that “We are open to transferring all of our 5G technologies, not just licensing production to others. This will include source programmes and source code to all the hardware design secrets as well as the know-how, and the chip design.”

The senior executive made the statement during the opening ceremony of the intelligent mining innovation lab in Taiyuan. Over the last several months, a few regions like the US, Australia, the UK, and some European nations have banned the company from selling its 5G equipment to local telecom operators over alleged security risks. Huawei has actively denied any allegations and has even called for open trade policies.

Ren further added that “Both the US and China need to develop their economies, as this is good for our society and financial balance. Everyone needs this. The Chinese tech giant has considered the plans for a factory in the region since back in March, regardless, of the French government’s crack down against telecom operators that used its equipment.

Telecom operators in the UK could now face severe fines after a new law was announced by the Parliament earlier this week. Under the new law, telecos could be fined 10 percent of their revenues for using telecommunications equipment from Huawei.

The new proposed Telecommunications Security Bill was designed to improve the security in the country’s 5G networking and full fiber infrastructure. As per a CNBC report, the new bill will have telecom carriers ensure that the equipment and software being used at their mast sites and telephone exchanges will have to meet a certain standard. According to the UK Department of Culture, Media, and Sport, “This will be a significant step to protect the U.K. from hostile cyber activity by state actors or criminals. Over the past two years the government has attributed a range of cyber attacks to Russia and China, as well as North Korea and Iranian actors.”

If the bill is approved, the government will be able plan fines on telecom operators that can have them pay 10 percent of turnover or 100,000 Pounds (roughly 133,000 US Dollars) a day if they fail to comply with the new regulations. Digital Secretary Oliver Dowden further added that the bill “will give the U.K. one of the toughest telecoms security regimes in the world and allow us to take the action necessary to protect our networks.”

In other words, the bill would also give the government the power to fine any operator found using equipment from blacklisted firms like Huawei in the nation’s 5G infrastructure. Just earlier this year, the UK government stated that carriers would no longer be able to buy telecommunication equipment from Chinese firms by the end of 2020, and will have to replace any existing technology by 2027. Italian President of Huawei Luigi De Vecchis says the company is ready to show the internal operations of its technology including 5G networks. This comes as a response to all political pressure that’s surmounting the company. His message comes at a time when the United States has warned Italy and Germany saying that Huawei is a tool for Human Rights abuse.

De Vecchis has reportedly made the proposal at the opening ceremony of the group’s cyber-security center in Rome. He says he is speechless after seeing a country like the USA can attack a company from China of groundless accusations. He also mentions that the company is ready to open its insides and get vivisected. That said, the scrutiny can probably show the world that its technology is not dangerous to those who use it.

Also, De Vecchis says that despite the pressure, Huawei has no intention to leave the Italian market. Instead, it is considering exploring the field of energy and add it to the tally of products. This is surprising as the company is also looking to expand its local business in China to strengthen the supply chain.

That said, the company’s Italian division including other countries is under a lot of pressure from the US. These comments come in the wake of US Secretary of State Mike Pompeo’s visit to Italy. Post the US ban, Chinese giant Huawei has bought stakes in multiple tech and semiconductor companies in a bid to invigorate the affected supply chain. A report by Reuters says that the move is to focus more locally rather than opting for overseas companies.

Setup in April 2019, Huawei’s Habo Investments has reportedly finished close to 17 deals since August 2019. The deal is for buying stakes from Chinese tech companies as per the public records. Most of the deals are with start-ups and some companies include Vertilite, Shoulder Electronics, 3Peak, and more. Recently, it has also invested in Open Source China, which is behind China’s Github alternative, Gitee. While we aren’t aware of the exact valuations, the report says Habo’s normally acquires 5-10% as per the filings.

Vertilite, founded in 2015, makes (vertical-cavity surface-emitting lasers)VCSEL sensors for facial-recognition in Cameras. And Huawei has reportedly used its sensors in a number of devices. Shoulder Electronics makes RF filters for wireless communications but still lacks compatibility of 5G phones. 3Peak makes ADC(Analogue-Digital Converters) for network base stations.

Besides, Habo’s investments include companies outside of telecom operations as well. If reports are true, its investment in chips, raw materials, and battery technology companies suggests that Huawei self-driving cars aren’t far away from reality.

All these investments are reportedly the response to US restrictions on the company. A former Huawei staff is quoted saying that the company usually does its own R&D but has turned towards investments only as the last resort. However, analysts predict that Huawei is far from recovering its Smartphone and network operations. They say that these investments will take time to reap benefits but Huawei is left with nothing else to do.

Ivan Platonov from Researching firm EqualOcean says, most of the companies are small and not globally competitive despite being good at their job. For instance, 3Peak’s annual revenue in 2019 is reportedly only $43.99 million. However, the US companies dominate the ADC market already. That said, Huawei’s investments are on the lines of the Chinese government’s steps to improve the silicon sector. Nevertheless, let’s play the waiting to see if Huawei can harvest well with these investments in the future.

In shocking news, a Huawei building has caught fire today in China. Reports from China say that a building near the company’s research laboratory caught fire at around 3:16 PM local time. The premises is located in the industrial city of Dongguan, China.

Chinese media SCMP says that the fire broke out in the building under construction. It is located on the Alishan Road at Songshan lake in Dongguan, China as per the fire department. Footage spread on social media shows a huge chunk of smoke coming out of the building. Reports say that the building is a steel structure, and remained unused at the time of incident. Further, reports say that the cause of the fire might be due to the sound-absorbing flammable materials like Cotton present inside the building.

Moreover, the report adds that the fire was extinguished around 4:50 PM. While there is no exact information on the casualties, three people were apparently found dead at the facility after the fire was put-off.

However, the report quotes that Huawei was not available for an official comment on the incident. That said, the report says the building is near a research facility in which testing of 4G and 5G antennas are done. Apparently, it is a part of the Huge manufacturing facility which is related to the company’s network business.

Dongguan is located in the Guangdong province of China. Although Huawei’s HQ is in Shenzen, it has assets worth more than $1.5 billion at the Songshan lake campus near-by. Also, the campus is famous for its European-themed buildings and has around 25,000 employees. Nevertheless, we will have to wait for official confirmation from Huawei to know the exact amount of damage and casualties.

Aside from the ban placed on Huawei, the US government has continued to mount pressure on its allies to boycott Huawei’s 5G gears. The US’ effort has been yielding results as some countries like the UK are already contemplating making a U-turn. On the other hand, France may not be planning an outright ban at the moment but the European country won’t be encouraging telecommunication companies to use Huawei’s 5G gears.

Reuters credits the head of the French cybersecurity agency ANSSI to have stated that there would not be a total ban on using equipment from Huawei in the rollout of the French 5G telecoms network, but that it was pushing French telcos to avoid switching to the Chinese company.

“What I can say is that there won’t be a total ban. (But) for operators that are not currently using Huawei, we are inciting them not to go for it,” Guillaume Poupard told Les Echos newspaper in an interview.

Reuters attributes sources to have disclosed in March that France would not ban Huawei but just like the UK and other countries, would seek to keep the Chinetech giant out of the core mobile network. The core mobile network carries higher surveillance risks because it processes sensitive information such as customers’ personal data.

The U.S. government has repeatedly claimed that Huawei’s5G gears could be used by China to spy on the West, hence the sustained pressure on allies to use alternatives instead of the Chinese company. The US has even offered to provide funding for countries to buy 5G gears from Huawei’s rivals.

Huawei has severally denied that its 5G gears pose any security risk from China.
