<p>A similar incident occurred recently where an unauthorized seller was selling knockoff Huawei earbuds by fooling customers. The guilty party named Shenzhen Jinyun Video Equipment Co., Ltd. infringed on Huawei&#8217;s trademark and also used the &#8220;FREEBUDS&#8221; trademark for the counterfeit products. They also used taglines like &#8220;official genuine Huawei only&#8221; and &#8220;official original equipment&#8221; on their online products page to trick customers.</p>

<p>After numerous complaints from the victims of this long-running scam, Huawei investigated the matter and sued Shenzhen Jinyun Video Equipment Co., Ltd for trademark and copyright infringement. Other than that, Huawei also demanded 3 million yuan ($450,000 approx) for economic losses and also demanded that the accused bear the litigation cost.</p>
<p>The case was heard in the Yuhang District People’s Court of Hangzhou City, Zhejiang Province, China, which ruled in Huawei&#8217;s favor and ordered Shenzhen Jinyun Video Equipment Co., Ltd to pay Huawei an amount of 1 million yuan ($150,000 approx) as compensation.</p>

<p>According to Cedar Lane Technologies, the Chinese tech giant has infringed on multiple different patents including JPEG compression, scene recognition, electro-luminescent devices, image processing systems, VR camera, and more. Cedar Lane alleged that the smartphone maker has infringed one particular patent on a variety of its products such as smartphones like the <a href="https://www.gizmochina.com/product/huawei-mate-xs/" target="_blank" rel="noopener noreferrer">Mate Xs</a>, <a href="https://www.gizmochina.com/product/huawei-mate-x/" target="_blank" rel="noopener noreferrer">Mate X</a>, <a href="https://www.gizmochina.com/product/huawei-mate-20/" target="_blank" rel="noopener noreferrer">Mate 20</a>, <a href="https://www.gizmochina.com/product/huawei-mate-20-pro/" target="_blank" rel="noopener noreferrer">Mate 20 Pro</a>, <a href="https://www.gizmochina.com/product/honor-view-10/" target="_blank" rel="noopener noreferrer">Honor View 10</a>, <a href="https://www.gizmochina.com/product/huawei-honor-8/" target="_blank" rel="noopener noreferrer">Honor 8</a> and even tablets like the<a href="https://www.gizmochina.com/product/huawei-mediapad-m5-10-8/" target="_blank" rel="noopener noreferrer"> MediaPad M5</a>, <a href="https://www.gizmochina.com/product/huawei-mediapad-m6-8-4/" target="_blank" rel="noopener noreferrer">MediaPad M6</a>, and <a href="https://www.gizmochina.com/product/huawei-mediapad-t5-10/" target="_blank" rel="noopener noreferrer">MediaPad T5</a>.&#8221;</p>

<p>Cedar Lane said that these products have been &#8220;made, used, sold, imported, and offered for sale by Defendant.” The infringement from Huawei revolves around one particular patent, namely 527 patent, which covers “[a] method for interfacing analog/digital converting means and JPEG compression means, said JPEG compression means having a built-in memory device, comprising the steps of: sequentially reading a predetermined number of image lines from the image data output of said analog/digital converting means.”</p>

<p>The plaintiff claimed that since Huawei utilized this image conversion method, it infringes on its patents. Cedar Lane has also stated that it had &#8220;employees internally test and use these Exemplary Products.” In other words, Huawei had knowledge about the patent but still created products, which was grounds for this infringement suit.</p>

In fact, a couple of days back, the US Department of Justice filed a formal indictment against Huawei, accusing it of several serious charges like racketeering, conspiracy, and theft.</p>

<p>The officials said they had evidence to show Huawei had backdoor access, but so far, they have failed to show it to the world. And yesterday, Huawei&#8217;s cybersecurity chief hit back at those officials daring them to publish this evidence. Huawei’s cybersecurity chief John Suffolk said, &#8220;We just say: &#8216;Don’t hide it, don&#8217;t be shy. Publish it, let the world see it&#8217;.&#8221;</p>
<p>He explained that Huawei had to connect its equipment to the &#8216;lawful intercept gateway&#8217; required by governments but had no access to it, which are often kept in a special room. These are the backdoors in the network which can tap into calls and data for law enforcement agencies under specific circumstances like that of a court order.</p>
<p>Suffolk said, &#8220;We have no access to this equipment, we don’t know what call or information is being intercepted, we don’t know when it is intercepted &#8211; all we do is provide one side of the box which is blind to what’s happening on the other side of the box.&#8221;</p>

<p>&#8220;I’m not aware of any operator who has said to Huawei: ‘Come and sit in this room and see what’s going on’,&#8221; he said.</p>
<p>&#8220;If I found out that our staff were involved with such things, then we would take appropriate action on that.&#8221;</p>
<p>He also added how the claims about Huawei stealing trade secrets from competitors didn&#8217;t make sense because if it was true, its competitors should have been growing at a significant rate. He said that if Huawei had stolen lucrative trade secrets from its competition, then these companies should have been doing at least as well as Huawei.</p>
<p>“The faith of our customers — and you can see this in the results over the past 30 years — gives an indication of what our customers think of those allegations,” Suffolk said.</p>

As part of its most aggressive move yet, <a href="https://www.gizmochina.com/tag/Huawei/">Huawei</a> has filed a lawsuit in a US District Court in Plano, Texas, throwing down the gauntlet to a 2019 US defense bill that restricts federal agencies from getting their hands on Huawei-branded products as well as its services.</p>
<p>The new US law even prevents US government agencies from collaborating with third parties that buy products or services from Huawei.</p>
<p>In his latest statement, Huawei&#8217;s rotating chairman Guo Ping pointed out that the US Congress hasn&#8217;t been able to support its decision to ban Huawei products with sufficient shreds of evidence. As a result, the company is left with no choice but to take this legal action.</p>
<p>&#8220;If this law is set aside, as it should be, Huawei can bring more advanced technologies to the United States and help it build the best 5G networks,&#8221; Guo Ping added.</p>

<p>According to the <a href="https://www.gizmochina.com/tag/US/">United States</a>, equipment manufactured by Huawei is highly likely to be exploited by the Chinese Communist government in order to keep other countries under surveillance and interfere with crucial communications.</p>
<p>While the world gears up for the hotly-anticipated arrival of ultra-fast <a href="https://www.gizmochina.com/tag/5G/">5G </a>telecommunications, Washington is persuading the government to stand aloof from the company. The 5G telecommunication can be deemed as an improvement that Huawei was slated to lead.</p>
<p>Responding in retaliation, Huawei has initiated an aggressive PR campaign. Keeping in line with that, reclusive founder Ren Zhengfei has been debunking the apprehensions in a slew of foreign media interviews.</p>
<p>Taking its campaign of flattery to the next level, Huawei invited news organizations on a reticent tour of its mammoth production lines along with its research and development facilities that are located in southern Guangdong province.</p>
<p>Huawei&#8217;s Chief Financial Officer Meng Wanzhou, Ren&#8217;s daughter faces probable deportation from Canada to the U.S. citing charges of Iran sanctions violations.</p>

<p><em>&#8220;We hope Samsung will &#8230; stop infringing our patents and get the necessary license from Huawei, and work together with Huawei to jointly drive the industry forward,&#8221; </em>said Ding Jianxing, president of Huawei&#8217;s Intellectual Property Rights Department, in a statement</p>
<p>Huawei&#8217;s lawsuit asks for compensation in US and China for the unlicensed use of 4G technology, operating systems and user interface software inside Samsung&#8217;s smartphones. While we aren&#8217;t sure whether the Chinese giant is looking for a monetary compensation, it is said that the company could be looking for a deal wherein it could use Samsung&#8217;s technology. This could potentially help Huawei in its plans to expand its international plans, which has been slow, but still better than competitors like <a href="http://www.gizmochina.com/2016/02/02/xiaomi-denies-partnership-with-us-mobile-no-plans-to-expand-to-the-us/">Xiaomi </a>and Meizu.</p>

<p>Huawei has been doing well in the past couple of years, expanding its smartphone lineup and continuously upgrading its flagships with new technology. The company already has a couple of <a href="http://www.gizmochina.com/2016/05/19/huawei-p9-honor-v8-shipments-around-2-million-every-month-says-analyst/">dual camera smartphones</a> in the market, as well as <a href="http://www.gizmochina.com/2015/09/02/water-resistant-huawei-mate-s-official-with-force-touch-fingerprint-2-0/">3D touch phones</a>. In fact, Huawei reported that it invested more than $9 billion in R&amp;D last year and owned 50,377 patents globally by the end of 2015.</p>
