<p><br>A Chinese vendor who was caught selling mosquito killer lamps and earphones with the <a href="http://gizmochina.com/tag/huawei">Huawei</a> trademark has been fined up to $294,000. The fine of 2 million yuan to the goods seller was for trademark infringement. The company named in the documents filed at China’s trademark office was Shenzhen Zhiyuan Network Technology Co. Ltd. Huawei had filed an unfair competition dispute against the company.</p>

<figure class="wp-block-image size-large"><img loading="lazy" width="1024" height="768" src="https://www.gizmochina.com/wp-content/uploads/2023/02/huawei-1024x768.jpg?x10805" alt="" class="wp-image-514290" srcset="https://www.gizmochina.com/wp-content/uploads/2023/02/huawei-1024x768.jpg 1024w, https://www.gizmochina.com/wp-content/uploads/2023/02/huawei-300x225.jpg 300w, https://www.gizmochina.com/wp-content/uploads/2023/02/huawei-768x576.jpg 768w, https://www.gizmochina.com/wp-content/uploads/2023/02/huawei-696x522.jpg 696w, https://www.gizmochina.com/wp-content/uploads/2023/02/huawei-1068x801.jpg 1068w, https://www.gizmochina.com/wp-content/uploads/2023/02/huawei-560x420.jpg 560w, https://www.gizmochina.com/wp-content/uploads/2023/02/huawei-80x60.jpg 80w, https://www.gizmochina.com/wp-content/uploads/2023/02/huawei-265x198.jpg 265w, https://www.gizmochina.com/wp-content/uploads/2023/02/huawei.jpg 1280w" sizes="(max-width: 1024px) 100vw, 1024px" /></figure>

<p>Huawei stated that it believed Zhiyuan’s products with the words Huawei infringed on its rights, and thus liable for compensation. The documents which have entered the public domain in China indicated that Huawei listed the mosquito killer lamps and earphones as the products in contention. Both products were sold via the Zhiyuan Company’s online store and were marked with the words Huawei. In addition, both products prominently used a logo similar to Huawei’s in the online page’s picture.</p>

<p>The plaintiff, Huawei notes that the action of Zhiyuan was a trademark infringement. There were other words used by the respondent to connote a non-existent connection with Huawei. The respondent was therefore accused of conducting false publicity which constitutes unfair competition. Huawei says it wants the defendant to bear joint and several liabilities on behalf of its company. The defendant was Mr. Tang, who argued that he was not the sole shareholder of the company.<br>Up to nine product links were identified by Huawei with an estimated sale of over 500,000 units. </p>

<figure class="wp-block-image size-full"><img loading="lazy" width="911" height="584" src="https://www.gizmochina.com/wp-content/uploads/2023/02/mosquito-lamps-fined-huawei.jpg?x10805" alt="" class="wp-image-514291" srcset="https://www.gizmochina.com/wp-content/uploads/2023/02/mosquito-lamps-fined-huawei.jpg 911w, https://www.gizmochina.com/wp-content/uploads/2023/02/mosquito-lamps-fined-huawei-300x192.jpg 300w, https://www.gizmochina.com/wp-content/uploads/2023/02/mosquito-lamps-fined-huawei-768x492.jpg 768w, https://www.gizmochina.com/wp-content/uploads/2023/02/mosquito-lamps-fined-huawei-696x446.jpg 696w, https://www.gizmochina.com/wp-content/uploads/2023/02/mosquito-lamps-fined-huawei-655x420.jpg 655w" sizes="(max-width: 911px) 100vw, 911px" /></figure>

<p>The estimated sales amount was 7.55 million yuan ($1.11 million). The Court ruled that Zhiyuan Company copied and imitated the Huawei trademark. This action infringed the plaintiff’s right to exclusive use of the Huawei trademark. Furthermore, the prominent use of Huawei and other logos on the product pages and names of eight earphones also violated the rights of the plaintiff. The sole shareholder Tang X was thus mandated to jointly compensate Huawei for economic losses up to 2 million yuan ($264,000).</p>

The overall conference went very well, including the performance from the Chinese girl band, SNH48.</p>
<p><img loading="lazy" class="lazy aligncenter" title="Huawei Logo on Xiaomi's conference video" src="http://img.ithome.com/newsuploadfiles/2017/5/20170525_165221_525.jpg" alt="Huawei Logo on Xiaomi's conference video" width="434" height="625" data-original="http://img.ithome.com/newsuploadfiles/2017/5/20170525_165221_525.jpg" /></p>
<p>However, there was one thing that surprised everyone during the live streaming. Suddenly, in between the streaming, <a href="https://www.gizmochina.com/tag/huawei">Huawei </a>logo cropped up on the screen and stayed there for a couple of minutes. Now, remember this is Xiaomi&#8217;s conference and Huawei is a direct competitor to the company. So, seeing Huawei&#8217;s logo during Xiaomi&#8217;s live streaming was not only surprising, but it was also bad for the company&#8217;s reputation. And naturally, after seeing the logo, some viewers started to joke that Huawei is probably one of the sponsors of the event.</p>
<p><a href="https://www.gizmochina.com/wp-content/uploads/2017/05/iqiyi-apology-for-Mi-Max-2-conference.png?x10805"><img loading="lazy" class="aligncenter size-full wp-image-133157" src="https://www.gizmochina.com/wp-content/uploads/2017/05/iqiyi-apology-for-Mi-Max-2-conference.png?x10805" alt="iqiyi apology for Mi Max 2 conference" width="602" height="273" srcset="https://www.gizmochina.com/wp-content/uploads/2017/05/iqiyi-apology-for-Mi-Max-2-conference.png 602w, https://www.gizmochina.com/wp-content/uploads/2017/05/iqiyi-apology-for-Mi-Max-2-conference-300x136.png 300w" sizes="(max-width: 602px) 100vw, 602px" /></a></p>
<p>But the actual conference faced no such issues and it went well. So, who was the culprit? Well, iQIYI, is the one to blame here. If you have never heard of this name, iQiyi is China&#8217;s largest online video site. They were streaming the conference live and there was some kind of equipment failure in between due to which Huawei&#8217;s logo came up on the screen for around 2 minutes. Note that the issue was resolved in a couple of minutes, but the damage was already done.</p>

<p>&nbsp;</p>
<p><a href="https://www.gizmochina.com/wp-content/uploads/2017/05/huaweis-response-to-mi-max-2-technical-snag.png?x10805"><img loading="lazy" class="aligncenter size-full wp-image-133156" src="https://www.gizmochina.com/wp-content/uploads/2017/05/huaweis-response-to-mi-max-2-technical-snag.png?x10805" alt="huawei's response to mi max 2 technical snag" width="595" height="525" srcset="https://www.gizmochina.com/wp-content/uploads/2017/05/huaweis-response-to-mi-max-2-technical-snag.png 595w, https://www.gizmochina.com/wp-content/uploads/2017/05/huaweis-response-to-mi-max-2-technical-snag-300x265.png 300w" sizes="(max-width: 595px) 100vw, 595px" /></a></p>
<p>iQiyi did apologize for this technical snag. It looks like users on Weibo had started sending private messages to Huawei asking whether they were responsible for this. Of course, Huawei was quick to defend itself saying they didn&#8217;t have anything to do with their logo coming up on Mi Max 2 live video. Also, it added that Huawei wishes Xiaomi for the launch success.</p>
<p>Although this wasn&#8217;t a big issue since the conference went smoothly, online viewers did have something to laugh about in the process.</p>
