Huawei Technologies, the Chinese telecommunications giant, has taken legal action against the Spanish government’s recent regulations, potentially excluding the company from receiving state aid in the development of 5G networks. Spain had committed a substantial sum of over €500 million ($527 million) to enhance rural 5G infrastructure. However, the government specified that suppliers deemed “high risk” would be barred from this aid.

Huawei’s Spanish unit swiftly filed an administrative appeal, vehemently arguing that the exclusion of certain suppliers contradicts legal standards, is disproportionate, and is seemingly driven by political motives.

According to the contentious rules, critical components of 5G networks, such as equipment, components, and associated software, should not be sourced from suppliers labeled as “high risk” by Spain. Additionally, operators who have already deployed 5G technology might face equipment replacement if their supplier falls under the high-risk category. However, the Economy Ministry, responsible for formulating these rules, has yet to finalize the list of banned suppliers, leaving the telecom industry in suspense.

Huawei contends that the regulations impede operators’ freedom to choose suppliers based on objective criteria encompassing commercial, technical, and security requirements. Instead, the company claims the rules attempt to exclude certain suppliers based on what it perceives as arbitrary political criteria.

This legal challenge unfolds against the backdrop of the European Commission’s mounting pressure on member states to phase out Huawei and ZTE Corp. equipment from their advanced mobile networks. The EU, citing security concerns, prohibited the use of these vendors’ equipment in its internal systems, intensifying scrutiny on nations relying heavily on Chinese equipment, including Germany and Spain.

As of December 2022, a report by Strand Consult revealed that 38% of Spain’s 5G network was supplied by a Chinese vendor, underscoring the significant stakes involved. This legal battle in Spain closely follows Huawei’s appeal in Portugal against a decision made by the country’s cybersecurity council, which forbids operators from utilizing Huawei’s equipment in the construction of 5G mobile networks.

The outcome of these legal challenges could significantly influence the future landscape of 5G development in Europe, as governments grapple with balancing technological advancements with national security concerns. The telecom industry and stakeholders eagerly await further developments, poised on the edge of a pivotal decision that could reshape the trajectory of 5G networks in these nations.

To clarify, the Chinese tech giant is not banned from selling their smartphones to its Spanish customers. Although, the company’s devices have their access banned from the Spanish Government’s data servers which incudes employee emails. According to the report, a few members of the Ministry of Defense are still allowed to retain their Huawei handset for personal use but have been specifically instructed to use other devices to access data from the Ministry’s data servers (like emails). Members that are still using the Huawei smartphones to access such data must ‘immediately disconnect.’

Editor’s Pick: Realme Officially Bootloader Unlocks every smartphones models in China

Unlike the US which accused Huawei of espionage, Spain did not cite the exact reason for the ban. However, the reasons might be similar if they are considering the prevention of sensitive data leaks. Furthermore, a spokesperson from Huawei went on record to say that the company had never faced any cyber-security related issues in the past 30 years of its operations in over 170 countries; and “security” is the highest priority of Huawei.

Although this arrives as a sour moment for the company, Huawei is still second in position in terms of smartphone shipments in Europe in Q3 of 2019. The company is seeing steady growth in the region and even more so in China.

Huawei now has the Mate 30 Pro available for purchase at the Huawei Space Store in Madrid, Spain. However, there are limited quantities available, there is no Google Mobile Services installed, and you can only buy the phone in Space Silver 8GB RAM + 256GB version. Although there is no Google Mobile Services installed, there are ways to get it installed.

The price tag is €1099, just as it was announced at the September event. Huawei will give those who buy a unit a €299 voucher that can be used to purchase any items in the store. So technically, you are paying €800 for the phone. Do note that this is only applicable to those who buy between now and December 9.

The Mate 30 Pro has a 6.53-inch 1176 x 2400 OLED display with a wide notch at the top. It is powered by Huawei’s 7nm Kirin 900 processor.

The device has a 40MP f/1.6 primary rear camera, an 8MP f/2.4 telephoto camera with 3x optical zoom, another 40MP f/1.8 ultrawide camera, and a ToF camera. The main camera and telephoto camera both have optical image stabilization. The notch in front houses a 32MP selfie camera and a 3D ToF camera for Face ID. It also has an in-display fingerprint scanner.

Huawei ships the phone with EMUI 10 based on Android 10. There is a 4500mAh battery inside the phone and it supports Huawei’s 40W SuperCharge fast charge technology. It also supports 27W fast wireless charging and reverse wireless charging, so you can use it to wirelessly charge devices like your earbuds or even other phones.
