<p>For those unaware, back in January 2021, <a href="https://www.gizmochina.com/2021/01/15/huaweis-fight-against-5g-ban-in-sweden-fails-as-court-dismisses-appeal/" target="_blank" rel="noopener noreferrer">Supreme Administrative Court of Sweden had dismissed an appeal</a> by Chinese tech giant against its exclusion from the country’s 5G network rollout. The company&#8217;s equipment was banned from Sweden&#8217;s network and the sale of its 5G gear was also prohibited. The primary reason for the ban was to safeguard the security of Sweden. Huawei insisted that it is being targeted unfairly on false suspicion of links to the Chinese government.</p>
<p>In June, <a href="https://www.gizmochina.com/2021/06/23/huaweis-5g-ban-in-sweden-upheld-by-yet-another-swedish-court/" target="_blank" rel="noopener noreferrer">it faced another blow in the region as the court dismissed its second appeal</a> as well. Now, the company has filed another appeal stating that it has requested an oral hearing in the case. Although, the Court of Appeal can decide whether such a hearing should be held or a preliminary ruling from the European Court of Justice should be requested. This marks another region in Europe where the company is facing a ban.</p>

<p>Furthermore, the situation is made worse by the <a href="https://www.gizmochina.com/2021/10/01/us-legalization-against-huawei-zte-telecom-europe/" target="_blank" rel="noopener noreferrer">US legalization against Huawei and ZTE</a> telecom infrastructure in Europe. This move from the US seeks to provide support and funds to its allies in the Eastern Europe that are vulnerable to low cost telecom equipment from these Chinese firms. Meaning, the company is facing increased tensions and scrutiny in the west, as the US continues to pressure its allies to ban Huawei.</p>

<p><span style="font-weight: 400">The Swedish court upheld a ban on Huawei from selling 5G equipment in Sweden. Huawei had appealed the October 2020 ban of the company by Sweden&#8217;s telecoms regulator due to security concerns. This is the second appeal that Huawei would be losing in its pursuit to overturn the regulator&#8217;s decision. </span></p>
<p><span style="font-weight: 400">The ruling by the court affirms the need to safeguard the security of Sweden, which is of heavy importance and should be sustained. It was unlikely that Huawei would have gotten a reprieve from the Administrative court after the first Appeal in December was dismissed. </span></p>
<p><span style="font-weight: 400">Huawei continues to insist that it is being targeted unfairly on false suspicion of links to the Chinese government. It says it is disappointed with the verdict and would still pursue other legal options open to it. </span></p>
<p><span style="font-weight: 400">Sweden is not the only country in Europe that has restricted Huawei from participating in 5G equipment rollout. Huawei had hoped that its appeal would have led to the upturning of the decision by Sweden&#8217;s Post Telecom Authority to ban it from participating in the 5G rollout in the country. Huawei remains the global leader in 5G but it has been unable to wriggle itself away from the suspicion of being owned by the Chinese government. </span></p>
<p><span style="font-weight: 400">Huawei says it is currently studying the judgment and the court&#8217;s justification to determine whether to explore further legal remedies it may use to protect its legitimate interests. It says it is open to constructive dialogues with the parties involved for an amicable resolution of the issue in a practical manner. Huawei says it is willing to work with the regulatory body and other stakeholders to mitigate any security concerns that led to the initial blocklisting of the company. </span></p>

<p><a href="https://www.gizmochina.com/2020/11/07/huawei-has-reportedly-appealed-against-5g-network-ban-in-sweden/">Huawei had filed an appeal</a> earlier this month against a decision by the lower court, the Administrative Court of Appeal that allowed the country&#8217;s telecoms regulator PTS to resume 5G spectrum auctions without removing a previous ban on Huawei.</p>
<p>The court&#8217;s statement, in dismissing Huawei&#8217;s appeal, further pointed out that its ruling is final and therefore cannot be appealed.<br />
Huawei said it was still awaiting decisions on two other appeals it filed in November last year in relation to what it felt was an unjustifiable ban by PTS. Huawei had claimed that there would be serious consequences if PTS went ahead to hold the 5G auction while PTS conditions are subject to legal review.</p>

<p>Huawei, I&#8217;m a statement on Friday said it had hoped that the Supreme Court would take a broader approach to the issue of law and consider the appeal on other grounds put forward by Huawei.</p>
<p>Sweden had said in October 2020 that it would ban Huawei and Chinese rival <a href="http://gizmochina.com/tag/zte">ZTE</a> from its 5G rollout due to security concerns and risks. It gave companies taking part in 5G auctions until January 1, 2025, to remove both Huawei and ZTE&#8221;s gear from existing infrastructure and core functions.</p>
<p>Earlier last month, an Appeals Court had backed an appeal by PTS against a ruling by a lower court to stop the 5G auctions, but also said Huawei could pursue a legal challenge over its exclusion. PTS then said that it would resume the 5G spectrum auction on January 19. They have now reaffirmed that the auction will start as planned on Tuesday 19 January.</p>
