<p>It appears that the legal action is being taken after years of negotiations. With the case filed in the <a href="https://www.gizmochina.com/tag/delhi-high-court">Delhi High Court</a>, the company is seeking compensatory and punitive damages for alleged infringement of its Indian patents.</p>
<p>The firm has also sought injunctive relief from the court to prevent further infringement of its patents unless Xiaomi decides to take a license on fair, reasonable, and non-discriminatory terms set by the court.</p>

<p>In a statement, InterDigital CEO William J. Merritt said:<em> &#8220;Wireless and video standards play the important role of eliminating barriers to entry, enabling new companies – like Xiaomi – to enter the market and have success despite having made no investment in previous wireless research activities.&#8221;</em></p>
<p>Xiaomi is currently the largest smartphone brand in the Indian market and has captured around 29 percent of the market share. It is followed by Samsung, which <a href="https://www.gizmochina.com/2020/07/27/samsung-india-smartphone-shipments-q2-2020/">regained the second position</a> in India with 26 percent market share, inching close to take the pole position in the Indian smartphone market.</p>

<p>While the issue between both the companies seem to have been resolved, terms for the same have not been disclosed yet. In a statement, William J. Merritt, <a href="https://www.gizmochina.com/tag/interdigital">InterDigital</a>&#8216;s president and CEO, said: <em>&#8220;This agreement, reached amid challenging circumstances given the current economic downturn, highlights the strength of our business and the value of InterDigital’s contributions to multiple generations of wireless and video standards.&#8221;</em></p>

<p>For the uninitiated, Huawei had sued InterDigital in January 2019 in China, claiming unfair terms for the licensing its patents. Then in December last year, InterDigital sued Huawei accusing the company of infringing five patents related to industry standards for 3G, 4G and 5G telecommunications.</p>
<p>Patent infringement suits are very common in the technology industry. Early this year, filing <a href="https://www.gizmochina.com/2019/06/13/huawei-wants-verizon-to-pay-1-billion-for-compensation/">lawsuit against Verizon</a>, Huawei said in a statement that it has paid out more than $6 billion for use of patented technologies, with 80 percent of those license fees going to US-based companies. It also added that since 2015, Huawei received more than $1.4 billion in license fees for its own patents.</p>
<p>Huawei, which is the world&#8217;s leader which it comes to telecom equipment, has been caught in the middle of the <a href="https://www.gizmochina.com/tag/us-china-trade-war">US-China trade war</a> and has been put on trade blacklist by the US government since last year. This is severely impacted the Chinese giant&#8217;s ability to buy hardware, software and services from American companies.</p>

<p>The Philadelphia based company that does have a number of wireless technology patents are commonly used in mobile phones, USB sticks, portable hotspots, laptops and tablet PCs. Unfortunately, InterDigital not specifically blamed offense to Samsung, Nokia, ZTE and Huawei.</p>
<p>Until now continue simmering lawsuit filing by the United States in order to be investigated. And if it violates, the fourth product sales could be banned from the electronics giant in the USA.</p>
<p>This is not the first time for InterDigital, before this, InterDigital also sue Samsung and Apple, but then all they has been paying a license.</p>
