The two companies were locked in a patent dispute for several years, and now, the case was finally settled in 2022. As part of the settlement, Huawei and Xiaomi agreed to a global patent cross-licensing deal. Here are the details&#8230;</p>



<h2><strong><strong>Huawei and Xiaomi Not to Sue Each Other for Patent Infringement for 10 Years</strong></strong></h2>



<p>Huawei and Xiaomi announced on Wednesday that they have reached a global patent cross-licensing deal. The deal covers multiple communications technologies, including 5G. The deal is a significant development for both companies. Huawei is the world&#8217;s leading telecom equipment maker and a major player in the smartphone market. And as you know, Xiaomi is the world&#8217;s third-largest smartphone maker.</p>

<p>The terms of the deal were not disclosed, but it is likely that both companies will benefit from the agreement. Huawei will gain access to Xiaomi&#8217;s patents, which will help it to develop new products and services. Xiaomi will also benefit from the deal, as it will no longer have to pay patent licensing fees to Huawei.</p>



<p>The deal is also will help both companies to develop 5G products and services. The deal is expected to take effect in early 2024. This means that the deal will not be finalized until then. However, it is likely that the deal will be finalized as planned, as both companies have expressed their commitment to the agreement. The agreement will be in effect for 10 years. After that, the two companies may choose to renew the agreement or negotiate a new one.</p>

<p>The patents involved in the lawsuit are all 5G standard essential patents. With the commercialization of <a href="https://www.gizmochina.com/tag/5g">5G technology</a>, the essential patent licensing rates between patent owners and smartphone makers have been rising.</p>

<p>Nokia, the Finnish company that just settled the patent dispute with Daimler, is pushing ahead to enter the 5G field. It intends to take advantage of the patent war with OPPO to lay the groundwork for 5G standard-essential <a href="https://www.gizmochina.com/tag/patent">patent</a> fees.</p>
<p>Over the last ten years, Nokia has sued several different companies but this is likely the first time in the last decade to file a counter sued for patent infringement. This is due to a lack of high-quality assets or the lack of courage to confront Nokia head-on.</p>
<p>In July this year, Nokia filed dozens of patent infringement lawsuits against OPPO in about nine countries, including <a href="https://www.gizmochina.com/tag/india">India</a>, France, Germany, and the United Kingdom. While the reason behind this move hasn&#8217;t been announced, it&#8217;s likely that the companies failed to reach an agreement for the 5G patent license.</p>
<p>Ever since Nokia stopped making mobile phones (<a href="https://www.gizmochina.com/tag/hmd-global">HMD Global</a> has licensed Nokia brand for smartphones), the patent license fees play an important role for the Finland-based company. It is trying to find a foothold in the telecom equipment market and with Huawei facing several issues, there&#8217;s a greater chance for Nokia to get a majority of contracts.</p>
<p>Nokia has adopted the strategy of aggressive litigation to collect the licensing fees. Before OPPO, the company had filed a patent infringement lawsuit against Lenovo in the US, Brazil, India, Germany, and others. It lasted for more than a year and was settled by the companies earlier this year in April.</p>
<p>It will be interesting to see how this legal dispute ends. While there&#8217;s a high possibility of both the companies reached an agreement, the battle between the patent holder and license holder for using it could form new rules for the companies.</p>

<p>While the issue between both the companies seem to have been resolved, terms for the same have not been disclosed yet. In a statement, William J. Merritt, <a href="https://www.gizmochina.com/tag/interdigital">InterDigital</a>&#8216;s president and CEO, said: <em>&#8220;This agreement, reached amid challenging circumstances given the current economic downturn, highlights the strength of our business and the value of InterDigital’s contributions to multiple generations of wireless and video standards.&#8221;</em></p>

<p>For the uninitiated, Huawei had sued InterDigital in January 2019 in China, claiming unfair terms for the licensing its patents. Then in December last year, InterDigital sued Huawei accusing the company of infringing five patents related to industry standards for 3G, 4G and 5G telecommunications.</p>
<p>Patent infringement suits are very common in the technology industry. Early this year, filing <a href="https://www.gizmochina.com/2019/06/13/huawei-wants-verizon-to-pay-1-billion-for-compensation/">lawsuit against Verizon</a>, Huawei said in a statement that it has paid out more than $6 billion for use of patented technologies, with 80 percent of those license fees going to US-based companies. It also added that since 2015, Huawei received more than $1.4 billion in license fees for its own patents.</p>
<p>Huawei, which is the world&#8217;s leader which it comes to telecom equipment, has been caught in the middle of the <a href="https://www.gizmochina.com/tag/us-china-trade-war">US-China trade war</a> and has been put on trade blacklist by the US government since last year. This is severely impacted the Chinese giant&#8217;s ability to buy hardware, software and services from American companies.</p>

Reportedly, the popular smartphone maker approached as a business partner but then proceeded to hire key employees from Masimo. This includes Michael O&#8217;Reilly, the Vice President of Apple&#8217;s health technology department.</p>

<p>Both health care related companies, Masimo and Cercacor, claimed that its non-invasive monitoring system which operated with light had been stolen by Apple. Apparently, the smartphone manufacturer used this technology to overcome performance issues with its Watch offerings. The US based OEM is being accused of multiple counts of infringement among 10 different patents.</p>

<p>According to the patent description, the technology can be applied to WCDMA, TD-SCDMA, HSPA, &amp; LTE. Xiaomi is said to have used the technology in the <a href="https://www.gizmochina.com/product/xiaomi-mi-5x/">Mi 5X</a>, <a href="https://www.gizmochina.com/product/xiaomi-mi-max-2/">Mi Max 2</a>, and <a href="https://www.gizmochina.com/product/xiaomi-mi-note-3/">Mi Note 3</a> phones sold in China without getting permission. The plaintiff has therefore filed a lawsuit against Xiaomi technology Co. Ltd and Xiaomi Communication Technology Co. Ltd.</p>

<p>In the lawsuit filed, Wednesday, with the U.S. District Court for the Southern District of California, Qualcomm&#8217;s complaint claims Apple is in infringement of five patents relating to radio frequency transceivers, power efficiency in mobile CPUs, device power management and image enhancement using depth-based data (3D imagery).</p>
<p>Qualcomm is thus praying for an injunction from the court that would bar Apple from selling the GSM version of 2017 iPhone models; iPhone 8, iPhone 8 Plus and iPhone X because they do not feature the Qualcomm -made modem chip inside. It must be noted that AT&amp;T and T-Mobile are the companies who stock the GSM version of the 2017 iPhones in the U.S. Thus, those are the ones the lawsuit is targeting. In addition, Qualcomm is also seeking unspecified damages and court costs.</p>

<p>The persistent lawsuit is already affecting the business relationship between both companies. There are reports that Apple is planning for the 2018 iPhone models without Qualcomm&#8217;s modem chips. Instead, the leading smartphone manufacturer is said to be turning to Qualcomm&#8217;s rival Intel and MediaTek. Intel currently supplies the part for the GSM versions of the latest iPhones. At this time, the best bet would be an out of court settlement as the suits are getting too many. We&#8217;d continue to keep an eye on this to see how it pans out eventually.</p>
