One of the court cases before a regional court in Munich, Germany has been struck out. The patent infringement suit relates to patents bothering on search capabilities on the iPhone as well as four other search-related patent suits that are awaiting the court’s disposition.

The same court had last month issued a ruling against Apple which effectively prevents the company from selling the iPhone 7, iPhone 7 Plus, iPhone 8 and iPhone 8 Plus in the country. But this time around, the court thinks otherwise. In one of the multiple court cases, a regional court in Mannheim earlier this month threw out another patent infringement suit filed by Qualcomm against Apple describing it as “groundless”.

Qualcomm is seeking for a fine from the court against Apple for not fully complying with the German sales ban. The chip maker made reference to a press release by Apple following the ban, stating that the affected iPhone models would still be available from other retailers despite the ban. Obviously, there is no end in sight for this two gladiators.

There have been lawsuits and countersuits, from both ends and it still looks like the friction is picking up steam in the last few days. Apple is now reportedly alleging that Qualcomm infringed on eight Apple patents bothering on power efficiency. Qualcomm, on its part, has now filed a fresh lawsuit and asserts that the smartphone maker was rummaging through the closet where it keeps its intellectual property.

In the lawsuit filed, Wednesday, with the U.S. District Court for the Southern District of California, Qualcomm’s complaint claims Apple is in infringement of five patents relating to radio frequency transceivers, power efficiency in mobile CPUs, device power management and image enhancement using depth-based data (3D imagery).

Qualcomm is thus praying for an injunction from the court that would bar Apple from selling the GSM version of 2017 iPhone models; iPhone 8, iPhone 8 Plus and iPhone X because they do not feature the Qualcomm -made modem chip inside. It must be noted that AT&T and T-Mobile are the companies who stock the GSM version of the 2017 iPhones in the U.S. Thus, those are the ones the lawsuit is targeting. In addition, Qualcomm is also seeking unspecified damages and court costs.

The persistent lawsuit is already affecting the business relationship between both companies. There are reports that Apple is planning for the 2018 iPhone models without Qualcomm’s modem chips. Instead, the leading smartphone manufacturer is said to be turning to Qualcomm’s rival Intel and MediaTek. Intel currently supplies the part for the GSM versions of the latest iPhones. At this time, the best bet would be an out of court settlement as the suits are getting too many. We’d continue to keep an eye on this to see how it pans out eventually.

This time around, Qualcomm is doing the suing, accusing Apple of breaching the software licence contract they had in order to benefit rival chipmaker Intel. Qualcomm claims Apple shared vital information about its broadband modems manufacturing process with Intels.

In the court document filed midweek at a San Diego court, Qualcomm claims Apple used its commercial prowess to demand unprecedented access to highly confidential software details, including source code and thereafter shared same with Intel. The lawsuit details that the U.S phone maker first demand for highly confidential information on how its chips work on an unidentified wireless carrier’s network. The chipmaker claims Apple copied an Intel engineer in the said email. The court document also detailed another case of a request for information between an Apple engineer working for Intel and an Apple engineer working with Qualcomm in order to obtain technical information from Qualcomm.

Related: Qualcomm Files Another Lawsuit Seeking To Ban iPhones In China

Apple has declined to comment on the lawsuit but it is instructive to note that the phone maker started using Intel broadband modem chips on the iPhone 7 and is reportedly planning to completely stop using Qualcomm’s modem chips next year. Qualcomm and Apple are already locked in multiple lawsuits in the U.S and even in China and this just keeps straining their relationship.
