<p>Following the European Union&#8217;s DMA (Digital Market Act) that <a href="https://www.gizmochina.com/2023/11/09/apple-plans-allow-third-party-app-store-europe-2024/" target="_blank" rel="noreferrer noopener">moved Apple to compliance</a>, it appears that Australia is planning on cracking down on the dominance of tech giants as well.</p>



<h2>Tech giants may face new competition scrutiny in Australia</h2>



<p>For those unaware, many regions and governments are facing issues in challenging the dominance of tech giants in the digital market. EU set a major example as it managed to make Apple comply with its stricter regulations. Apple had a closed ecosystem with its App Store but recently allowed third party app stores in Europe. Australia is seeking to repeat this miracle and is pushing for new competition laws in the digital realms as well.</p>

<p>The latest report from <em><a href="https://www.reuters.com/technology/australian-regulator-calls-new-competition-laws-digital-platforms-2023-11-27/" target="_blank" rel="noreferrer noopener">Reuters </a></em>states that Australia&#8217;s competition agency is advocating for new laws that will adapt to the rapid growth of digital platforms like Amazon, Google, Meta, Microsoft, and Apple in the region. The ACCC (Australian Competition and Consumer Commission) added in a recent report that the Digital Platform Services Inquiry is concerned over the increased risk of wrongful behavior from these platforms. </p>



<p>These wrongfu behaviors could include invasive data gathering and locking in customers into a specific ecosystem and restricting their choices. ACCC Chair Gina Cass-Gottlieb said &#8220;Our proposed reforms include a call for targeted consumer protections and service-specific codes to prevent anti-competitive conduct by particular designated digital platforms.&#8221;</p>

Rivals of major corporations also face various obstacles, with complains taking too long to spot and sanction an anti competitive behavior. This delay can cause the rival to face irreparable damage towards their own business operations, as per a <a href="https://www.ft.com/content/46434ced-a4c9-47a0-8d78-1f1212ddf0e5" target="_blank" rel="noopener noreferrer"><em>FinancialTimes</em> </a>report.</p>

<p>Furthermore, Brussels is set to publish proposals next week, which will allow &#8216;regulators to go after fast-growing companies,&#8217; which are able to reach a kind of market dominance. Best examples of such cases include giants like <a href="https://www.gizmochina.com/tag/google/" target="_blank" rel="noopener noreferrer">Google</a> and <a href="https://www.gizmochina.com/tag/facebook/" target="_blank" rel="noopener noreferrer">Facebook</a>. While the goal is known, it is currently unsure what guidelines or step the EU will take to measure the company&#8217;s growth or take action.</p>

<p>EU’s executive vice-president in charge of the EU’s digital policy, Vestager stated that &#8220;It’s a way of introducing a forward-looking dynamic to complement what we do vigorously in enforcing competition law.” In other words, the larger corporations will be subject to a stricter list of obligations than their smaller rivals in terms of public listing. The new obligations may even have major firms be required to share data with their competitors or to the EU &#8216;gatekeepers&#8217;.</p>

<p>Vestager also added that she expects &#8220;a lot of pushback from this regulation when we table it because obviously it will restrict some market players and it will put on them new obligations.” She even stated that &#8220;this is not about the flag that you are flying&#8221; after Booking.com chief executive, Glenn Fogel, called the new regulations a &#8220;handcuff&#8221; on one of the &#8220;very, very, very few tech successes in Europe.”</p>

<p>It remains unclear how the United States government is defining the &#8220;use&#8221; of products. There&#8217;s also a possibility that the ban may soon be expanded to cover affiliates, subsidiaries, and parents of contractors.</p>
<p>The companies have two choices &#8212; either do business with the U.S. government or with the major suppliers. So far, it seems that companies are choosing to continue doing business with the United States.</p>
<p>Companies like Nippon Telegraph &amp; Telephone, NTT Data, <a href="https://www.gizmochina.com/tag/softbank">SoftBank</a> Group, and Kajima have said that they will ensure compliance with this new regulation and will refrain from using products and services from the likes of <a href="https://www.gizmochina.com/tag/huawei">Huawei</a> and ZTE.</p>
