<p>The South Korean tech giant is being sued by a company called K. Mizra LLC. For those unaware, a patent troll is basically a term used to describe an entity that acquires and collects patents. Rather than using the technology described in the patents, these companies generate revenue by using &#8220;aggressive&#8221; litigation and legal battles based on patents. Now, K. Mirzra claims that Samsung infringed on its patent that is related to smartphone battery technology.</p>
<p>The lawsuit was filed against the South Korean company on May 20 in the Dusseldorf Regional Court in Germany. As per the accusation, K. Mizra&#8217;s &#8220;battery runtime prediction as implemented in Samsung devices using younger versions of the Android OS infringes the German designation of its patent EP 2 174 201 B1.&#8221; In other words, the company infringed on a patent that describes an algorithm that can analyze users&#8217; behaviors to predict the remaining battery life of the smartphone.</p>
<p>This also enables the handset to showcase a more precise battery life estimate as well. Thus, K. Mizra claims that this Android based feature on Samsung Galaxy devices are based on the inventions covered in its patents. It remains to be seen how the patent dispute plays out. <p>According to a <a href="http://www.businesskorea.co.kr/news/articleView.html?idxno=86623" target="_blank" rel="noopener noreferrer"><em>BusinessKorea</em> </a>report, the lawsuit was filed by the Dublin based Scramoge Technology, which is a non practicing entity (NPE). The firm filed a patent infringement against the South Korean tech giant with the US District Court in Texas earlier this month. Scramoge Technology alleged that the brand has launched new products using its wireless charging technology without permission. This news arrives after the NPE purchased 123 patents related to wireless charging from LG Innotek back in 2021.</p>
<p>For those unaware, a patent troll is a <span class="ILfuVd"><span class="hgKElc">derogatory term</span></span> used to describe a <span class="ILfuVd"><span class="hgKElc">business that utilize patents and the court system to earn money. In other words, the company is using the patents it acquired from <a href="https://www.gizmochina.com/tag/lg-innotek/" target="_blank" rel="noopener noreferrer">LG Innotek</a> to sue Samsung. It had previously filed a similar lawsuit against the South Korean brand back in April 2021, and another one back August 2021. Those legal disputes were over the alleged infringement of the company&#8217;s newly launched <a href="https://www.gizmochina.com/product/samsung-galaxy-z-flip3-5g/" target="_blank" rel="noopener noreferrer">Galaxy Z Flip3</a> and <a href="https://www.gizmochina.com/product/samsung-galaxy-z-fold3-5g/" target="_blank" rel="noopener noreferrer">Galaxy Z Fold3</a> foldable phones.</span></span></p>

<p>Now, Scramoge Technology is stating that Samsung infringed on seven of its wireless charging patents, which included short range communication antenna solutions as well. Furthermore, the NPE has also filed for damages as it claims that the known consumer electronics maker caused damages to its business by selling its patented products in the US. As of right now, industry insiders believe that Samsung might face a difficult legal battle considering Scramoge Technology&#8217;s parent company is Atlantic IP Services, which is apparently known for being an infamous patent troll group.</p>

<p>According to a <a href="https://www.fiercewireless.com/financial/ericsson-files-lawsuit-against-samsung-patent-license-row" target="_blank" rel="noopener noreferrer"><em>FierceWireless</em> </a>report, the telecom giant is accusing Samsung of violating its obligations for essential patent licensing under <a href="https://www.gizmochina.com/tag/frand/" target="_blank" rel="noopener noreferrer">FRAND</a> (Fair, Reasonable and Non-Discriminatory) terms. Furthermore, Ericsson wants a declaratory ruling that the companny complied with its own licensing commitments. A Samsung spokesperson reached out to FierceWireless via email and stated that, &#8220;Once we receive the complaint, we will review it and determine an appropriate response.&#8221;</p>

<p>In an announcement on December 11, Ericsson stated that the royalty payments for its intellectual property could be delayed if the renewal negotiations do not conclude before the current one expires. According to the telecom equipment provider, the delay in royalty payments and potential cost of litigation could have Ericsson see an operating income hit between roughly 118 to 177 million US Dollars starting in the first quarter of next year.</p>

<p>Ericsson filed the complaint against Samsung in the District Court for the Eastern District of Texas. In the complain, the company stated that, &#8220;“Without 4G and 5G technology and Ericsson’s inventions incorporated therein, smartphones and other mobile devices would not be able to provide the constant on-the-go access to video, streaming media, and gaming that consumers expect today.” It further added that both parties, &#8220;understood that Samsung would owe Ericsson a substantial balancing payment.”</p>

The lawsuit, filed by the British nanotechnology company, Nanoco, alleges that <a href="https://www.gizmochina.com/tag/samsung">Samsung</a> and its affiliates have infringed on its patents relating to Quantum Dots, the technology behind the company&#8217;s popular <a href="https://www.gizmochina.com/tag/QLED">QLED</a> TVs. Reuters reports that Nanoco is looking to obtain a permanent injunction against Samsung as it has &#8220;<em>willfully infringed the company’s patents and seeks a permanent injunction from further acts of infringement and significant monetary damages.&#8221;</em></p>

<p>&#8220;<em>Historically the group worked collaboratively with Samsung on developing enhanced quantum dots based on our unique and patented CFQD Quantum Dot technology and associated IP,&#8221; </em>said Nanoco’s Chairman Christopher Richards. <em>&#8220;We were therefore naturally disappointed when Samsung ended the collaboration and launched its QD [Quantum Dot] based televisions without entering into either a licensing or supply agreement with Nanoco</em>.&#8221;</p>
<p>QLEDs form a very important part of Samsung&#8217;s TV market. Samsung <a href="https://pulsenews.co.kr/view.php?year=2019&amp;no=1061366">reportedly</a> sold over 5.9 million QLED TVs in 2019 alone. So, the lawsuit could turn out to be very expensive for the company, potentially costing millions, if not billions in lost revenue.</p>

The Australian Competition and Consumer Commission (ACCC) filed a lawsuit stating that Samsung misled consumers by showing ads that put its phones at the bottom of the pool and in the ocean.</p>

<p><a href="https://www.gizmochina.com/tag/samsung">Samsung&#8217;s</a> higher-end models are IP68 certified which means its water and dustproof. In order to market this feature, the company often resorted to ads which show the phone being used inside pools and beaches. ACCC claims that these ads mislead customers because Samsung&#8217;s <a href="https://www.gizmochina.com/tag/ip68">IP68</a> phones are only tested for waterproofing in freshwater sources. So, it states that the company hasn&#8217;t sufficiently tested the effects of pool or saltwater exposure on its phones.</p>
<p><em>“The ACCC alleges Samsung’s advertisements falsely and misleadingly represented Galaxy phones would be suitable for use in, or for exposure to, all types of water, including in ocean water and swimming pools, and would not be affected by such exposure to water for the life of the phone, when this was not the case,” </em>ACCC Chair Rod Sims said.</p>

<p>Those who are familiar with IP68 rating might already know the waterproof smartphones in the market today from <a href="https://www.gizmochina.com/tag/huawei">Huawei</a> to Apple to Samsung are tested in freshwater sources only. In fact, Samsung mentions this on its website. However, ACCC claims that Samsung did little to explain this fact in its advertisements.</p>
<p>ACCC lawsuit concerns all waterproof smartphones released by Samsung since 2016 including <a href="https://www.gizmochina.com/tag/galaxy">Galaxy</a> S series flagships, Note series, and a handful of waterproof A series models.</p>
