<p>The development comes a couple of days after it was announced that the U.S. Department of Commerce has reached an agreement with China&#8217;s ZTE Corp to lift the ban. The ban was imposed after the company broke an agreement reached after it pleaded guilty for illegally shipping U.S. goods and technology to Iran, which is in violation of U.S. sanctions.</p>
<p>As a part of the agreement, the company has deposited $400 million in an escrow account. The escrow agreement is part of a $1.4 billion settlement it <a href="https://www.gizmochina.com/2018/06/06/zte-signs-agreement-to-lift-ban/">reached with the Commerce Department</a> last month to regain access to U.S. suppliers, whose components it relies on for its smartphones and networking gear.</p>
<p>The new settlement also includes a <a href="https://www.gizmochina.com/2018/06/08/zte-fined-1-billion-deal-reached-with-u-s-administration-to-lift-ban/">$1 billion penalty</a> that ZTE paid to the U.S. Treasury last month and the $400 million in the escrow account that the United States. The government could seize the escrow amount if ZTE violates the latest settlement. Also, the $1 billion penalty is in addition to nearly $900 million ZTE paid last year.</p>
<p>Under the new settlement, ZTE was required to change its board and management within 30 days. In addition, the company must hire an outside compliance monitor selected by the Commerce Department.</p>

Note that the company employs 75,000 workers and its value was about $20 billion before the ban. Thanks to this new deal between the U.S. administration and ZTE, tensions with the Chinese president Xi Jinping, who has personally asked Donald Trump to save the company, will surely defuse. It is worth mentioning that lawmakers are not very happy with this deal (top Republicans too).</p>
<p>According to them, it is not in the interest of the US to help a Chinese company that evidently broke American law and was accused to be a national security threat. <p>As part of the deal, ZTE has also reportedly promised to replace its board and executive team in 30 days. It would also allow unfettered site visits to verify that U.S. components are being used as claimed by the company and post calculations of U.S. parts in its products on a public website.</p>
<p>Under this new agreement, ZTE will retain compliance contractor in addition to the three-year court-appointed monitor imposed by the plea agreement. The sources said that ZTE has also agreed to allow U.S. representatives to make site visits without coordinating with Chinese government officials, as required by a non-public agreement between the countries.</p>
<p>Last month, ZTE Corp had <a href="https://www.gizmochina.com/2018/05/07/zte-applies-to-u-s-commerce-department-for-suspension-of-export-ban/">submitted an application</a> to the U.S. Commerce Department’s Bureau of Industry and Security (BIS) seeking for the suspension of a business ban. While it was not clear what the company included in the application, the company had provided additional material at the BIS’s request.</p>
<p>Over the weekend, ZTE signed the agreement in principle drawn up by the United States, but the amended settlement agreement has not yet been signed. Earlier this year, in April, the company announced that it has <a href="https://www.gizmochina.com/2018/05/11/zte-corp-ceases-main-business-operations/">ceased its major business operations</a> as the seven-year ban was imposed on the company.</p>
<p>The <a href="https://www.gizmochina.com/2018/04/17/new-us-ban-may-mean-no-zte-axon-9-or-worse/">ban was imposed on ZTE</a> after the company failed to comply with an agreement with the Commerce Department in 2017 when it pleaded guilty in federal court in Texas to conspiring to evade U.S. embargoes by illegally shipping U.S. goods and technology to Iran.</p>

<p>Senior Commerce Department officials have said that ZTE had agreed to dismiss four senior employees and discipline 35 others either by reducing their bonuses or reprimanding them. However, the company admitted that while it had fired the four senior employees, it had made false statements about the others.</p>

<p>While this will affect ZTE greatly, who relies on US suppliers for up to 43 percent of its components, US chipmakers will also be affected adversely. Qualcomm and Intel will no longer be able to sell its chipsets to the Chinese smartphone maker, possibly affecting its sales and revenue in the coming quarters.</p>

<p>Ban on sales to ZTE may not just result into short terms losses for these companies. Chinese Government has always stressed on being independent, and this might present as a good opportunity for ZTE to invest in component manufacturers in its home country. So, even if the ban is lifted in the coming months, not all of the company&#8217;s previous business might return back to US. So, it looks like companies like Qualcomm, Intel and even Broadcom could lose some business as a result of this ban.</p>
